RESOLUTION NO. 2022 -
<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
<br />FLORIDA, APPROVING A THIRD AMENDMENT TO THE AGREEMENT WITH G.
<br />CONCRETE DEVELOPMENT, INC. FOR THE BELLA VISTA BAY PARK
<br />RECONSTRUCTION, IN AN AMOUNT NOT TO EXCEED NINETY THOUSAND
<br />DOLLARS ($90,000.00), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE
<br />MAYOR TO EXECUTE SAID AMENDMENT; AUTHORIZING THE CITY MANAGER
<br />TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING
<br />FOR AN EFFECTIVE DATE.
<br />WHEREAS, the City of Sunny Isles Beach ("City") issued and advertised Request for
<br />Proposal ("RFP") No. 19-10-01 for the Reconstruction of the Bella Vista Park dock ("Services"),
<br />for which two (2) responses were received, and it was determined that G. Concrete
<br />Development, Inc. ("Contractor") was the lowest responsible, responsive bidder whose bid best
<br />served the interests of and represents the best value to the City; and
<br />WHEREAS, on December 19th, 2019, via Resolution No. 2019-3022, the City Commission
<br />awarded the RFP to, and entered into an Agreement with, the Contractor to perform the
<br />Services, in an amount not to exceed $366,602.50; and
<br />WHEREAS, on September 14, 2021, via Resolution No. 2021-3243, the City Commission
<br />ratified a First Amendment to the Agreement with the Contractor for mangrove removal, in an
<br />amount not to exceed $90,409.60, bringing the total contract amount not to exceed
<br />$457,012.10; and
<br />WHEREAS, on February 17, 2022, via Resolution No. 2022-3299, the City Commission
<br />approved a Second Amendment to the Agreement with the Contractor for the relocation of an
<br />existing electrical panel, increased materials cost, and a 275 -day extension, in an amount not to
<br />exceed $53,670.43; and
<br />WHEREAS, the Contractor has submitted a quote for further upgrades to the existing
<br />electrical panel and water service reconnection, in an amount not to exceed $90,000.00; and
<br />WHEREAS, this Third Amendment also includes an additional time extension of 140 days
<br />to achieve project completion; and
<br />WHEREAS, the City wishes to approve the Third Amendment to the Agreement with G.
<br />Concrete Development, Inc., for the Bella Vista Bay Park Reconstruction, in a total amount not
<br />to exceed Ninety Thousand Dollars ($90,000.00), bringing the total contract amount not to
<br />exceed Six Hundred Thousand Six Hundred Eighty -Two Dollars and Fifty -Three Cents
<br />($600,682.53), attached hereto as Exhibit "A".
<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
<br />ISLES BEACH, FLORIDA, AS FOLLOWS:
