Contractor agrees to maintain <br />Business Automobile Liability with minimum limits of One Million Dollars <br />($1,000,000.00) per occurrence combined single limit for Bodily Injury Liability and <br />Property Damage Liability. Coverage must be afforded on a form no more restrictive <br />than the latest edition of the Business Automobile Liability policy, without restrictive <br />endorsements, as filed by the Insurance Services Office, and must include: Owned <br />Vehicles; Hired and Non -Owned Vehicles; and Employers' Non -City ship. <br />Before starting the Work, the Contractor will file and make sure that all certificates of <br />insurance required by the RFP and by the Contract are in the City's possession. These <br />certificates shall contain a provision that the coverage afforded under the policies will not <br />be canceled or materially changed until at least thirty (30) days prior written notice has been <br />given to the City by certified mail. The City shall be named as an additional insured on the <br />above -referenced policies. <br />The Contractor agrees that if any part of the Work under the Contract is sublet, they will <br />require the Sub-Contractor(s) to carry insurance as required, and that they will require the <br />Sub-Contractor(s) to furnish to them insurance certificates similar to those required by the <br />City in this section. <br />13.4 Worker's Compensation & Employer's Liability. Contractor agrees <br />to maintain Worker's Compensation & Employers Liability Insurance in accordance with <br />Florida Statutes, including Employer's Liability of $1,000,000. <br />13.5 Builder's Risk Insurance Contractor agrees to maintain coverage that <br />shall be "All Risk" coverage for one hundred percent (100%) of the completed value of the <br />structure(s), building(s) or addition(s). Where contract calls for install of machinery or <br />equipment, the policy must be endorsed to provide coverage on "All Risk" basis during <br />transit and installation. The policy must be issued with a deductible of not more than $50,000 <br />per claim. <br />13.6 Waiver of Subrogation. Contractor agrees by entering into this written Contract <br />to a Waiver of Subrogation in favor of the City, Contractor, Sub -Contractors, Architects, <br />or Engineer for each required policy providing coverage during the life of this Contract. <br />When required by the insurer or should a policy condition not permit the Contractor to enter <br />into a pre -loss Contract to waive subrogation without an endorsement, the Contractor <br />agrees to notify the insurer and request the policy be endorsed with a Waiver of Transfer <br />of Rights of Recovery Against Others, or an equivalent endorsement. This Waiver of <br />Subrogation requirement shall not apply to any policy, which includes a condition that <br />specifically prohibits such an endorsement, or voids coverage should the Contractor enter <br />into such Contract on a pre -loss basis. <br />13.7 Right to Revise or Reject. Contractor agrees the City reserves the right, but not <br />the obligation, to review or revise any insurance requirement, not limited to limits, <br />coverages and endorsements based on insurance market conditions affecting the availability <br />or affordability of coverage; or changes in the scope of work specifications affecting the <br />applicability of coverage.
