<br />City of Sunny Isles Beach |Request for Proposal No. 22-09-01 15 <br /> <br /> <br />Base percentage rate: Firm must propose a base percentage rent in Section 6.1. The <br />percentage rate is subject to annual negotiated increases. <br /> <br />Landlord/Owner: City of Sunny Isles Beach <br /> 18070 Collins Avenue <br /> Sunny Isles Beach, FL 33160 <br /> <br />Tenant: (TBD) <br /> <br />Premises: 18050 Collins Avenue <br /> Sunny Isles Beach, FL 33160 <br /> <br />Initial Term: Ten (10) years, commencing on the Commencement Date <br /> <br />Renewal Terms: Two (2) terms of five (5) years each, with rent due thereunder at <br />the then existing fair market value as determined by the City in <br />its sole reasonable discretion (i.e., adjusted for CPI). <br />2.8 TERM: <br />The Initial Term of the Lease shall be as set forth in the Fundamental Lease Provisions. Provided Proposer <br />is not then in default under this Lease, and subject to City approval, the Lease may be extended by the <br />number of the successive mutually agreeable written Renewal Terms described in the Fundamental Lease <br />Provisions. If Tenant wishes to exercise its option to renew the Lease, it shall provide the City written notice <br />of its election to extend the term of the Lease by not less than ninety (90) days prior to expiration of the <br />Initial Term or the then running Renewal Term, as the case may be. The terms and conditions of the Lease <br />shall apply during each Renewal Term. <br />2.9 LICENSES AND CITY PERMITS: <br /> <br />The Operator shall be required to obtain and maintain all governmental licenses or permits <br />required for the proper and lawful operation of the restaurant and activity carried on in the <br />Premises, including all licenses and permits to operate indoor and outdoor food services and to <br />serve alcohol, if applicable. Licensee shall conform to all licensing and/or permit requirements, <br />regulations and guidelines under the State of Florida Department of Agriculture and Consumer <br />Services Division of Food Safety, and/or the State of Florida Department of Business and <br />Professional Regulation, including, but not limited to the Department of Health, Building and Fire <br />of Miami Dade County, Florida and the Commission of Sunny Isles Beach ordinances and <br />regulations. Such proposer costs associated with regulatory requirements shall be taken into <br />consideration from the proposer, as depicted specifically within the body of the proposal. <br />
