City of Sunny Isles Beach <br />18070 Collins Avenue <br />Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 City Hall <br />(305) 949-3113 Fax <br />MEMORANDUM <br />TO: Honorable Mayor and City Commissioners <br />VIA: Stan Morris, City Manager <br />FROM: Amy Canales, Planning and Zoning Director <br />DATE: September 15, 2022 <br />RE: Proposed Comprehensive Plan Property Rights Element <br />RECOMMENDATION: <br />Staff recommends approval of this Ordinance. <br />REASONS: <br />Effective July 1, 2021, the Florida legislature required that all local governments amend their <br />comprehensive plans to adopt a property rights element to ensure that private property rights are <br />considered in all decision-making. F.S. 163.3177(6)(i)(1) lists several," statements of rights" that must <br />be incorporated into all property rights elements, and which constitute the City's proposed element. <br />The statute prohibits local governments from adopting non -mandatory amendments to their <br />comprehensive plans before adopting a property rights element. <br />ATTACHMENTS: <br />Ordinance <br />Item Number: 9.A <br />103 <br />
