c,rp as sw+ <br />City of Sunny Isles Beach <br />18070 Collins Avenue <br />Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 City Hall <br />(305) 949-3113 Fax <br />MEMORANDUM <br />TO: Honorable Mayor and City Commissioners <br />FROM: Stan Morris, City Manager <br />DATE: June 16, 2022 <br />RE: Ordinance Amending Chapter 251 "Property Assessed Clean Energy Program <br />RECOMMENDATION: <br />staff recommends adoption of this Ordinance. <br />REASONS: <br />On November 15, 2018, the City adopted Ordinance No. 2018-533, establishing a Property Assesses <br />Clean Energy Program in the City ("PACE Program"), which is codified in Chapter 251 of the City's Cod <br />of Ordinances ("Code"). The stated purpose of the City's PACE Program is to allow a property owner tc <br />voluntarily finance energy efficient, renewable energy, or wind resistant improvements through a non - <br />ad valorem assessment implemented and managed by a PACE Local Government and repaid througf <br />the annual tax bill. <br />In developing its PACE Program, the City created program standards that have proven too onerous <br />and have become a barrier to PACE Local Governments providing services in the City, especially witl <br />respect to commercial PACE transactions ("C -PACE"). In the interest of increasing participation in the <br />PACE Program, the City's program standards need to be clarified so that select consumer protectior <br />measures are applied solely to residential properties participating in the PACE Program, thereby <br />allowing commercial transactions to not be governed by or subject to said standards. C -PACE <br />transactions are negotiated with a great degree of sophistication and frequently with benefit of legal <br />representation, thus the need for stringent consumer protection measures is not present for C -PACE, <br />as it is for residential PACE transactions. <br />ATTACHMENTS: <br />Ordinance <br />Item Number: 9.0 <br />56 <br />
