RESOLUTION NO. 2023 - " V. <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, EXPRESSING SUPPORT FOR HOUSE BILL 269 WHICH PROHIBITS THE <br />DISTRIBUTION OF CERTAIN MATERIALS EVIDENCING RELIGIOUS OR ETHNIC <br />ANIMUS AND ENHANCES CRIMINAL PENALTIES FOR PERSONS WHO COMMIT <br />THESE VIOLATIONS; URGING THE FLORIDA LEGISLATURE AND GOVERNOR RON <br />DESANTIS TO SUPPORT AND APPROVE THE LEGISLATION; DIRECTING THE CITY <br />CLERK TO DISTRIBUTE COPIES OF THIS RESOLUTION; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, during the 2023 Legislative Session of the State of Florida, Representatives <br />Caruso and Lopez sponsored House Bill 269, commonly referred to as the "Public Nuisances Bill" <br />("HB 269"); and <br />WHEREAS, HB 269 amends sections 403.413, 784.048, 806.13, and 871.01 of the Florida <br />Statutes to better address and prevent harmful behavior; and <br />WHEREAS, HB 269 prohibits the distribution of certain materials that leads to littering, as <br />well as the projection of certain images onto buildings or other property without permission, <br />provides enhanced criminal penalties for persons who commit violations while evidencing <br />religious or ethnic animus, and reclassifies and increases penalties for those who commit such <br />offenses; and <br />WHEREAS, HB 269 is an important step towards creating a safer and more inclusive <br />community for all residents of the State of Florida; and <br />WHEREAS, the City of Sunny Isles Beach ("City") affirms its stance and denounces all forms <br />of discrimination and hate crimes; and <br />WHEREAS, the City Commission finds that the passage of the aforementioned bill is in the <br />best interest of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Support of House Bill 269. The City Commission hereby expresses support for <br />House Bill 269, and urges the Florida Legislature to adopt, and Governor Ron DeSantis to support <br />and approve, the bill. <br />Section 2. Directions to the City Clerk. The City Clerk is hereby directed to distribute copies <br />of this Resolution to Representatives Caruso and Lopez, Governor Ron DeSantis, the Speaker of <br />the Florida House of Representatives, the President of the Florida Senate, the Florida League of <br />Cities, and the Miami -Dade League of Cities. <br />Section 3.
