At the option of the City, either the bank shall eliminate or reduce <br />such deductible or it shall procure a Bond, in a form satisfactory to the City, covering the same. <br /> <br />2.12 FEDERAL, STATE AND LOCAL REGULATIONS <br />The successful Contractor shall comply with all federal, state and local ordinances, regulations, and rules as <br />well as any other laws that would apply to the proposed project. Contractor costs associated with regulatory <br />requirements shall be included in the project cost whether depicted specifically or not within the body of <br />the proposal. <br />2.13 CONTRACTING WITH SMALL AND MINORITY BUSINESSES, WOMEN'S BUSINESS ENTERPRISES, AND <br />LABOR SURPLUS AREA FIRMS (2 CFR §200.321) <br />If your firm is a certified minority business enterprise as defined by the Florida Small and Minority Business <br />Assistance Act of 1985, include your certification with your response. C.F.R. 200.321 encourages the active <br />participation of minority businesses, women’s business enterprises and labor surplus area firms as a part of <br />any subsequent agreement whenever possible. If subcontracts are to be permitted, through a prime <br />Contractor, that Contractor is required to take the affirmative steps listed in items (1) through (6) below: <br />(1)Placing qualified small and minority businesses and women's business enterprises on solicitation lists; <br />(2)Assuring that small and minority businesses, and women's business enterprises are solicited whenever <br />they are potential sources; <br />(3)Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit <br />maximum participation by small and minority businesses, and women's business enterprises; <br />(4) Establishing delivery schedules, where the requirement permits, which encourage participation by small <br />and minority businesses, and women's business enterprises; <br />(5)Using the services and assistance, as appropriate, of such organizations as the Small Business <br />Administration and the Minority Business Development Agency of the Department of Commerce. <br />(6)Requiring the prime contractor, if subcontracts are to be let, to take the affirmative steps listed in <br />paragraphs (1) through (5) of this section. <br />2.14 STORAGE OF MATERIALS <br />The Consultant must provide for own storage of material and equipment, if needed. No on-site storage is <br />permitted at the work area or other public areas, unless it is pre-approved by the City. <br />2.15 SUB-CONTRACTORS <br />If the Contractor proposes to use subcontractors in the course of providing these services to the City, this <br />information shall be a part of the bid response. Such information shall be subject to review, acceptance and <br />approval of the City, prior to any contract award. The City reserves the right to approve or disapprove of <br />any subcontractor candidate in its best interest and to require Contractor to replace subcontractor with <br />one that meets City approval. <br />Contractor shall ensure that all of Contractor’s subcontractors perform in accordance with the terms and <br />conditions of this Contract. Contractor shall be fully responsible for all of Contractor’s subcontractors’ <br />performance, and liable for any of Contractor’s subcontractors’ non-performance and all of Contractor’s <br />subcontractors’ acts and omissions.
