k • �p�sx__ _+�q • wr <br />cr d4 <br />Yy OF 54YM h <br />City of Sunny Isles Beach <br />18070 Collins Avenue <br />Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 City Hall <br />(305) 949-3113 Fax <br />MEMORANDUM <br />TO: Honorable Mayor and City Commissioners <br />FROM: Valerie Vicente, City Attorney <br />DATE: April 20, 2023 <br />RE: Amendment to Chapter 235 of City's Code to Create Article II "Wate <br />Quality" <br />RECOMMENDATION: <br />Staff recommends approval of this Ordinance. <br />REASONS: <br />The City has found that illicit discharge to the city's stormwater system results in the damage and loss <br />of natural resources, including the degradation of water quality, and also accelerates the process of <br />soil erosion and exposes sediment to surface stormwater runoff, resulting in the damage and loss of <br />natural resources, including the degradation of water quality posing a public health risk. <br />City staff often finds that storm drains are not properly protected or maintained, allowing an <br />accumulation of pollutants to enter the stormwater system and discharge into waterways. As an <br />operator of Municipal Separate Storm Sewer Systems ("MS4") and a co -permittee of Nationa <br />Pollution Discharge Elimination System (NPDES) Permit No. FLS000003-004, the city must prohibit illicit <br />discharge, illicit connections, improper disposal and illegal dumping into the stormwater system, and <br />sediment and erosion reducing best management practices. <br />Through the enactment of this ordinance, staff seeks to establish a Code for property standards and <br />nuisances, including for construction sites, which will be set forth in Chapter 235, Article I I of the City': <br />Code of Ordinances. The ordinance will also allow for the implementation of permitting procedures <br />and standards to establish preventive jobsite practices that can minimize environmental risks from the <br />erosion, air pollution, and sedimentation on sites with disturbed soil resulting from <br />construction/demolition sites. <br />Item Number: 9.13 <br />
