<br /> RFP # 23-05-02 23 <br /> <br />CITY OF SUNNY ISLES BEACH <br />18070 Collins Ave. | Sunny Isles Beach, FL 33160 <br />305.792.1707 | sibfl.net | Purchasing@sibfl.net <br /> <br />Any and all employees and/or other individuals retained by proposer, shall not, for any <br />purposes, be considered to be employees of the City of Sunny Isles Beach, and proposer shall <br />be solely responsible for their supervision and daily direction and control. <br /> <br />3.17 COMPLAINTS AND DISPUTES <br /> <br />All complaints will be forwarded to the contract manager. If the incident requires formal <br />investigation, the proposer will be notified of the complaint by certified mail. The proposer <br />will have seven (7) business days to reply to the complaint in writing. After the investigation <br />is completed, a memo will be forwarded to the Chief of Police regarding the outcome. If the <br />complaint is sustained, a recommendation of disciplinary action against the proposer will be <br />forwarded to the Chief of Police. <br /> <br />The proposer agrees that any complaints received by the City concerning misconduct on the <br />part of the proposer, such as excessive charges, poor business practices, damage to vehicles, <br />etc., that cannot be resolved between the proposer and the Police Chief’s designee, will be <br />referred to the Police Chief's office for appropriate action, including contract termination. If <br />the complaint is not resolved to the satisfaction of the Police Chief or the owner of the vehicle, <br />it may be referred to the City Manager's office. <br /> <br />3.18 PRIVATE COMMERCIAL TOWING COMPANIES <br /> <br />The City has the right to waive awarding bids from towing companies contracted to tow for private <br />commercial businesses within the City limits of Sunny Isles Beach due to conflicts of interest. <br /> <br />3.19 NON-EXCLUSIVE SERVICES <br /> <br />Nothing contained in this contract will prevent the owner or operator of a motor vehicle from calling <br />a wrecker or tow truck of their choice, or requesting that their vehicle be towed to a garage location <br />or compound of his/her choice and not that of the City’s proposer (s) for Towing Services, unless the <br />disabled vehicle cannot be removed in forty (40) minutes or less is creating a tie up of traffic or <br />hazardous situation, in the opinion of the officer at the scene. <br /> <br />3.20 CLEANUP <br /> <br />The Contractor, after arrival at the scene of an accident in which a tow is required by his firm, will be <br />responsible for removing from the street all broken glass and other nonhazardous matter that may be <br />in the street as a result of the accident. The cost of such normal accident cleanup shall be included in <br />the basic towing rate and no separate charge made to the City or vehicle owner. In the event the <br />accident creates a major oil or fuel spill, or other unusual circumstance that requires additional <br />Contractor staff or equipment the cost of such staff or equipment shall be charged to the vehicle owner <br />as complications.
