ARTICLE 7 - CITY'S RESPONSIBILITIES <br />7.1 CITY shall furnish data required of CITY under the Contract Documents promptly. <br />The CONTRACTOR understands and agrees that any information provided to it by the CITY as to <br />any aspect of the Project is not guaranteed but contractor shall have the right to reasonably rely on <br />any data provided by the City and the City shall not knowingly provide false or inaccurate data. <br />7.2 Contractor shall secure all necessary assessments, charges, approvals and permits <br />required for construction, use, or occupancy of permanent structures or permanent changes in existing <br />facilities. <br />7.3 If the Work is defective, or CONTRACTOR fails to supply sufficient skilled workers <br />or suitable materials or equipment, or fails to furnish or perform the Work in such a way that the <br />completed Work will conform to the Contract Documents, CITY may order CONTRACTOR to stop <br />the Work, or any portion thereof, until the cause for such order has been eliminated; however, this <br />right of CITY to stop the Work shall not give rise to any duty on the part of CITY to exercise this <br />right for the benefit of CONTRACTOR or any other party. <br />ARTICLE 8 — CITY MANAGER <br />8.1 City Manager will be CITY'S contact person during the construction period and until <br />final payment is due to CONTRACTOR. <br />8.2 Visits to Site. <br />City Manager may, at the City Manager's sole discretion, make visits to the site to <br />observe the progress and quality of the executed work. <br />8.3 Authorized Variations in Work. <br />City Manager may authorize minor variations in the Work from the technical <br />requirements of the Contract Documents which are mutually agreed to and do not involve an <br />adjustment in the Guaranteed Maximum Price or the Contract Time and are consistent with the overall <br />intent of the Contract Documents. These may be accomplished by a Field Order and will be binding <br />on CITY and on CONTRACTOR who shall perform the work involved promptly. <br />8.4 Rejecting Defective Work. <br />If City Manager becomes aware of any fault or default in the Work, he may give <br />written notice thereof to CONTRACTOR. The failure to provide notice shall not waive the warranty <br />of the CONTRACTOR that the work is to be free of defect whether latent or patent. <br />ARTICLE 9 - BUILDING DEPARTMENT'S RESPONSIBILITIES <br />It is understood and agreed by the CONTRACTOR that the Building Department and its <br />inspectors are professionals who are dedicated to providing efficient and courteous service to all <br />18 <br />
