Contractor agrees to maintain General <br />Liability, at a limit of liability not less than $1,000,000 Each Occurrence $2,000,000 <br />Annual Aggregate on a primary and non-contributory basis, including the City of Sunny <br />Isles Beach as an Additional Insured. Coverage must be offered in a form no more restrictive <br />than the latest edition of the Comprehensive General Liability policy, without restrictive <br />endorsements, as filed by the Insurance Services Office, and shall specifically include <br />the following with minimum limits not less than those required for Bodily Injury <br />Liability and Property Damage Liability: <br />— Premises and Operation; <br />— Independent Contractors; <br />— Products and/or Completed Operations Hazard; <br />— Broad Form Property Damage <br />— Broad Form Contractual Coverage applicable to this Contract, including <br />any hold harmless and/or Indemnification Agreement; <br />— Personal Injury Coverage with Employee and Contractual Exclusions <br />removed, with minimum limits of coverage equal to those required for Bodily <br />Injury Liability and Property Damage Liability; <br />$3,000,000 Umbrella/Excess Liability over and above and following the <br />above mentioned General Liability & Business Automobile Liabilities. <br />13.3 _Business Automobile Liability. Contractor agrees to maintain Business <br />Automobile Liability at a limit of liability not less than $1,000,000 per Occurrence <br />combined single limit for Bodily Injury Liability and Property Damage Liability. Coverage <br />must be afforded on a form no more restrictive than the latest edition of the Business <br />Automobile Liability policy, without restrictive endorsements, as filed by the Insurance <br />Services Office, and must include: Owned, Non -Owned & Hired automobiles. <br />13.4 Worker's Compensation & Employer's Liability. Contractor agrees to <br />maintain Worker's Compensation & Employers Liability Insurance in accordance with <br />Florida Statutes, including Employer's Liability of $1,000,000. <br />13.5 Waiver of Subrogation. Contractor agrees by entering into this written Contract <br />to a Waiver of Subrogation in favor of the City, Contractor, Sub -Contractors, Architects, or <br />Engineer for each required policy providing coverage during the life of this Contract. When <br />required by the insurer, or should a policy condition not permit the Contractor to enter into a <br />pre -loss Contract to waive subrogation without an endorsement, the Contractor agrees to <br />notify the insurer and request the policy be endorsed with a Waiver of Transfer of Rights of <br />Recovery Against Others, or an equivalent endorsement. This Waiver of Subrogation <br />requirement shall not apply to any policy, which includes a condition that specifically prohibits <br />such an endorsement, or voids coverage should the Contractor enter into such Contract on a pre - <br />loss basis. <br />13.6 Right to Revise or Reject. Contractor agrees the City reserves the right, but not <br />the obligation, to review or revise any insurance requirement, not limited to limits, coverages <br />and endorsements based on insurance market conditions affecting the availability or <br />affordability of coverage; or changes in the scope of work specifications affecting the <br />C" 32 <br />
