Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby <br />ratified and confirmed as being true and the same are hereby made part of this Resolution. <br />Section 2. Findings and Conclusions. Based upon an analysis of the application and <br />the standards for approval for a conditional use approval under the Land Development <br />Regulations and the Comprehensive Master Plan of the City, the City Commission makes the <br />following findings and conclusions: <br />The Application for conditional use approval for a veterinary clinic to be located on a <br />B-1 zoned property located at 18600 Collins Avenue is consistent with the Land <br />Development Regulations and the Comprehensive Master Plan of the City of Sunny <br />Isles Beach. <br />Section 3. Approval. The Applicant's request for approval of a conditional use for a <br />veterinary clinic to be located on a B-1 zoned property located at 18600 Collins Avenue, is hereby <br />APPROVED, subject to the following conditions: <br />1. Upon the submittal of an application for a building permit, the plans submitted shall <br />be approved by the Planning and Zoning Department and be consistent with the <br />specific plan presented to the City Commission. That the plans in the approval be <br />substantially in accordance with that submitted for public hearing, the plans are <br />entitled "Interior Alteration to an Existing Commercial Space for a Veterinary Clinic," <br />prepared by RN Engineering, Inspection & Construction, Inc. stamped received July <br />24, 2023, consisting of three sheets and a Survey prepared by Gavy & Associates, Inc. <br />stamped received July 6, 2023, consisting of one sheet. Plans are subject to revisions <br />based on comments provided by zoning staff of the City of Sunny Isles Beach. Plans <br />are subject to modification. <br />2. That the Applicant shall obtain all necessary permits and licenses from all external <br />agencies, including, but not limited to Department of Business and Professional <br />Regulations (DBPR), Department of Environmental Protection (DERM), etc. for a <br />veterinary clinic. <br />3. That the proposed veterinary clinic, stipulated in the application, shall comply with <br />Specific Use Regulations of City Code Section 265-44(K) for veterinary clinic. No <br />boarding or kennel services are to be provided and no outdoor kennels or runs are <br />allowed on-site. <br />4. That the approved conditional use shall remain valid for a period of 24 -months from <br />the date of the conditional use approval. If no building permit or certificate of use is <br />issued within the 24 -month time period, the conditional use shall be considered null <br />and void and of no force and effect. <br />42 <br />
