RESOLUTION NO. 2023 - J <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, TERMINATING THE STATE -FUNDED GRANT AGREEMENT WITH THE <br />STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (FPN 445792-1-54-01) <br />PROVIDING FOR GRANT FUNDING FOR THE PROPOSED PEDESTRIAN PARK <br />BRIDGE AT 174" STREET; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, on November 21, 2019, via Resolution No. 2019-3016, the City Commission <br />of the City of Sunny Isles Beach ("City") approved a Stated -Funded Grant Agreement with the <br />Florida Department of Transportation ("FDOT") to partially fund the construction of a <br />Pedestrian Park Bridge ("Pedestrian Bridge") in an amount not to exceed Four Hundred Twenty - <br />Five Thousand Dollars and No Cents ($425,000.00) ("Agreement"); and <br />WHEREAS, the State -Funded Grant Agreement was fully executed and entered into by <br />the City and FDOT on February 20, 2020; <br />WHEREAS, to date, the City has not proceeded with the project and has not received <br />any of the grant funds; and <br />WHEREAS, pursuant to Paragraph 5(b) of the Agreement, the parties may terminate the <br />Agreement when "its continuation would not produce the beneficial results commensurate <br />with the further expenditure of funds;" and <br />WHEREAS, the City Commission has determined that the proposed Pedestrian Park <br />Bridge would not produce the beneficial results commensurate with the further expenditure of <br />funds; and <br />WHEREAS, the City now wishes to terminate the Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified <br />and confirmed as being true and the same are hereby made part of this Resolution. <br />Section 2. Approving the Termination of the FDOT State -Funded Grant Agreement. The <br />City Commission hereby approves the termination of the FDOT State -Funded Grant Agreement, <br />dated February 20, 2020 (FPN 445792-1-54-01). <br />Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all <br />things necessary to effectuate this Resolution. <br />Section 4. Effective Date.
