City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 (305) 947-0606 phone (305) 949-3113 Fax 5.4 Completion and Final Past 5.4.1 When all of the Work is finally complete and the Contractor is ready for a final inspection, it shall notify the City and the City's Representative thereof in writing. Thereupon, the City's Representative will make final inspection of the Work and, if the Work is complete in full accordance with the Contract Documents and this Contract has been fully performed, the City's Representative will promptly issue a final Certificate for Payment certifying to the City that the Project is complete and the Contractor is entitled to the remainder of the unpaid Contract Price, less any amount withheld pursuant to this Contract. If the City's Representative is unable to issue its final Certificate for Payment and is required to repeat its final inspection of the Work due to deficient work by Contractor or any party retained by the Contractor to perform work or supply materials under the Agreement, the Contractor shall bear the cost of such repeat final inspection(s) which cost may be deducted by the City from the Contractor's final payment. 5.4.2 As a condition precedent to final payment to the Contractor, the Contractor shall deliver to the City the following documents in a form acceptable to the City: a) Project Record Documents including As -built Drawings and Specifications, Addenda, Construction Schedule, Change Orders, and other modifications of the Contract, Approved Shop Drawings, Product Data and Samples, and Field Test records. b) Operating and Maintenance Instructions: Submit instructions and/or manuals for operating equipment and systems as prepared in accordance with the requirements of the applicable equipment specifications sections. c) Warranties and Bonds: As applicable and in accordance with the requirements of the individual sections of the specifications. d) Affidavit that all payrolls, invoices for materials and equipment, and other liabilities connected with the Work for which the City, or the City's property might be responsible, have been fully paid or otherwise satisfied. e) Lien releases and waivers of payment bond claims from all Subcontractors and releases from the Contractor to the City as required by the City's Representative or the City. f) Consent of surety to final payment. g) A duly executed assignment of any and all warranties required by the Contract Documents. h) Any and all operating manuals required by the Contract Documents. i) Any and all manuals relating to Project materials or Project maintenance. j) Executed change orders relating to any and all changes in the Work. k) Any and all as -built drawings required by the Contract Documents. If any third party fails or refuses to provide a release of claim or waiver of lien as required by the City, the Contractor shall furnish a Consent of Surety to the City and to discharge any such lien or indemnify the City from liability. 5.4.3 As a further condition precedent to final payment, the Contractor shall furnish to the City a complete and comprehensive set of as -built drawings; said as -built drawings are to be submitted in hard copy and in electronic format, and the City and the Contractor II
