Additional requirements <br />may apply dependingon the Federal Granting Agency provisions, please check with the City for <br />further details. Proposers shall be required to submit a completed Buy America Certificate with <br />this procurement, an incomplete certificate may deem the proposers submittal non-responsive. <br /> <br />Prohibition On Certain Telecommunications And Video Surveillance Services Or Equipment (2 <br />CFR § 200.216): Proposer and any subcontractors are prohibited to obligate or spend grant funds <br />to: (1) procure or obtain, (2) extend or renew a contract to procure or obtain; or (3) enter into <br />a contract to procure or obtain equipment, services, or systems that use covered <br />telecommunications equipment or services as a substantial or essential component of any <br />system, or as critical technology as part of any system. As described in Pub. L. 115-232, section <br />889, covered telecommunications equipment is telecommunications equipment produced by <br />Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities). <br />i. For the purpose of public safety, security of government facilities, physical security surveillance <br />of critical infrastructure, and other national security purposes, video surveillance and <br />telecommunications equipment produced by Hytera Communications Corporation, Hangzhou <br />Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or <br />affiliate of such entities). ii. Telecommunications or video surveillance services provided by such <br />entities or using such equipment. iii. Telecommunications or video surveillance equipment or <br />services produced or provided by an entity that the Secretary of Defense, in consultation with <br />the Director of the National Intelligence or the Director of the Federal Bureau of Investigation, <br />reasonably believes to be an entity owned or controlled by, or otherwise, connected to the <br />government of a covered foreign country. <br /> <br />Enhanced Whistleblower Protections (41 U.S.C. § 4712): An employee of Proposer and/or its <br />subcontractors may not be discharged, demoted, or otherwise discriminated against as a reprisal <br />for disclosing to a person or body described in 42 U.S.C. § 4712(a)(2) information that the <br />employee reasonably believes is evidence of gross mismanagement of a Federal contract or <br />grant, a gross waste of Federal funds, an abuse of authority relating to a Federal contract or grant, <br />a substantial and specific danger to public health or safety, or a violation of law, rule, or regulation <br />related to a Federal contract (including the competition for or negotiation of a contract) or grant. <br /> <br />Federal Funding Accountability and Transparency Act (FFATA)(2 CFR § 200.300; 2 CFR Part 170): <br />In accordance with FFATA, the Proposer shall, upon request, provide the City the names and total <br />compensation of the five most highly compensated officers of the entity, if the entity in the <br />preceding fiscal year received 80 percent or more of its annual gross revenues in federal awards, <br />received $25,000,000 or more in annual gross revenues from federal awards, and if the public <br />does not have access to information about the compensation of the senior executives of the <br />entity through periodic reports filed under section 13(a) or 15(d) of the Securities Exchange Act <br />of 1934 or section 6104 of the Internal Revenue Code of 1986. <br /> <br />Federal Awardee Performance and Integrity Information System (FAPIIS)( The Duncan Hunter <br />National Defense Authorization Act of 2009 (Public Law 110-417 and 2 CFR Part 200 Appendix <br />XII)): The Proposershall update the information in the Federal Awardee Performance and <br />Integrity Information System (FAPIIS) on a semi-annual basis, throughout the life of this contract, <br />by posting the required information in the System for Award Management via <br />https://www.sam.gov. <br /> <br />6 <br /> <br />
