<br />LITIGATION STATEMENT
<br />In the last five (5) years CGA has been involved in the
<br />following litigation:
<br />1. Vue Condominium Association, Inc. vs. Vue Fort
<br />Lauderdale, L.L.C., ET AL, Case No. CACE09012422
<br />.Suit was filed March 3, 2009. This is a typical con-
<br />dominium construction defect suit involving the de-
<br />veloper, contractor, numerous subcontractors and
<br />all the design team. The condominium association
<br />voluntarily dismissed its claim against Calvin, Gior-
<br />dano February 2011.
<br />2. Walnut Creek Community Development District vs.
<br />Standard Pacific of South Florida, GP, Inc., Et AI, Case
<br />No. CACE10019353. Suit was filed May 4, 2010. The
<br />case concerns the failure of an HDPE drainage sys-
<br />tem and is in the early stages of discovery. The oth-
<br />er parties include the developer, the pipe manufac-
<br />turer and the contractor which is defunct but which
<br />may have insurance coverage. Our understanding is
<br />that the problems are primarily the result of defec-
<br />tive manufacture of the HDPE pipe although design
<br />and construction deficiencies also are alleged. This
<br />case has been settled.
<br />filed in an attempt to collect payment from B.P. Ex-
<br />ploration and Production for services performed by
<br />Calvin, Giordano & Associates on behalf of Franklin
<br />County, Florida. This case has been settled.
<br />4. Villas at Harbor Isles Condo filed suit NO. CACE 09-
<br />043012(18) against Harbor Isles by Quantum, Inc.,
<br />et. al. (Calvin, Giordano & Associates, Inc.); filed in
<br />Broward County Circuit Court. Complaint original-
<br />ly filed 8/2009 (no claims against Calvin Giorda-
<br />no & Associates). Third Amended Complaint filed
<br />5/2012 including claims against Calvin Giordano
<br />& Associates. Condominium construction defects
<br />case with claims against Calvin Giordano involving
<br />alleged improper sloping at lake banks and improp-
<br />erly specific catch basin grate covers. This case has
<br />been settled.
<br />5. Merrick Preserve Condominium Association, Inc.
<br />v. Westbrooke Homes, Florida general partnership
<br />NO. CACE 08 11218(07); Third Party Complaint
<br />filed August 2011. Breach of Contract alleging fail-
<br />ure to include developer as an additional insured
<br />on commercial general liability policy; Contractual
<br />Indemnification and Common Law Indemnification
<br />claims involving alleged deficiencies in grading of
<br />back yards and paving of driveways resulting in
<br />ponding. Condominium defects suit in which devel-
<br />oper filed third party claims against subcontractors
<br />and design professionals. The case has been settled.
<br />6. Armando E. Silva, and Robin Silva, both individually
<br />and as natural parents and next friends of Spencer
<br />Silva and Heather Silva, minors, v. South Broward
<br />Hospital district, d /b /a Memorial Regional Hospi-
<br />tal, Hai-drives of Delray, Inc., d /b /a Hardrives, Inc.,
<br />a Florida Profit Corporation, Calvin, Giordano & As-
<br />sociates, Inc., a Florida Profit Corporation, and ANF
<br />Group, Inc., a Florida Profit Corporation, filed suit
<br />on October 2S, 2013 in the Broward County Circuit
<br />Court. NO. CACE13023917. Traffic accident. This
<br />case is in discovery.
<br />7. Edward B Wallace Plaintiff vs. Calvin, Giordano &
<br />Associates Inc Defendant. Whistle Blower. Suit
<br />filed on July 23, 2012 in the Broward County Circuit

<br />Florida filed lawsuit NO.4:2012cv00001 in the Flor-
<br />ida Northern District Court against B.P. Exploration 8. Kevin Young v. Calvin, Giordano & Associates, Inc.
<br />and Production Inc. in January 2012. The suit was ADA. This case is in discovery.
