include, but not be limited to, the following: employment, promotion,

<br />termination; rates of pay or other forms of compensation; and selection for
<br />training, including apprenticeship. In addition, the Contractor agrees to
<br />comply with any implementing requirements FTA may issue.

<br />3. Age. In accordance with the Age Discrimination in Employment Act,
<br />29 U.S.C. §§ 621-634, U.S. Equal Employment Opportunity Commission
<br />(U.S. EEOC) regulations, “Age Discrimination in Employment Act,” 29
<br />C.F.R. part 1625, the Age Discrimination Act of 1975, as amended, 42
<br />U.S.C. § 6101 et seq., U.S. Health and Human Services regulations,
<br />“Nondiscrimination on the Basis of Age in Programs or Activities Receiving
<br />Federal Financial Assistance,” 45 C.F.R. part 90, and Federal transit law
<br />at 49 U.S.C. § 5332, the Contractor agrees to refrain from discrimination
<br />against present and prospective employees for reason of age. In addition,
<br />the Contractor agrees to comply with any implementing requirements FTA
<br />may issue.

<br />4. Disabilities. In accordance with section 504 of the Rehabilitation
<br />Act of 1973, as amended, 29 U.S.C. § 794, the Americans with Disabilities
<br />Act of 1990, as amended, 42 U.S.C. § 12101 et seq., the Architectural
<br />Barriers Act of 1968, as amended, 42 U.S.C. § 4151 et seq., and Federal
<br />transit law at 49 U.S.C. § 5332, the Contractor agrees that it will not
<br />discriminate against individuals on the basis of disability. In addition, the
<br />Contractor agrees to comply with any implementing requirements FTA
<br />may issue.
<br />
<br />5. Sanctions for Noncompliance. In the event of the Contractor's
<br />noncompliance with the nondiscrimination provisions of this Contract, the
<br />FDOT shall impose such contract sanctions as it, the FTA, FDOT or the
<br />U.S. DOT may determine to be appropriate, including, but not limited to:
<br />withholding of payments to the Contractor under the Contract until the
<br />Contractor complies and/or cancellation, termination or suspension of the
<br />Contract, in whole or in part.
<br />
<br />Flow Down Requirements - This requirement flows down to all subcontracts at
<br />every tier. In all solicitations made by the Contractor and all subcontractors,
<br />either by competitive bidding or negotiation for work to be performed under a
<br />subcontract, including procurements of materials and leases of equipment, each
<br />potential subcontractor or supplier shall be notified in writing by the Contractor of
<br />the Contractor's obligations under this Contract and the Regulations relative to
<br />nondiscrimination on the basis of race, creed, color, sex, sexual orientation,
<br />gender identity, national origin, religion, age, disability, or family status and that
<br />these same obligations extend to any subcontractor, supplier or lessor.
