Disadvantaged Business Enterprises (DBEs). <br /> <br />FDOT - 49 C.F.R. part 26, 49 C.F.R. § 26.13(b), FTA Master Agreement FY2020 <br />at Section 12(e)(4)(ii), FTA C 4220.1F at Appendix D <br /> <br />Applicability - All contracts <br /> <br />This contract is subject to the requirements of Title 49, Code of Federal <br />Regulations, Part 26, Participation by Disadvantaged Business <br />Enterprises in Department of Transportation Financial Assistance <br />Programs and with section 1101(b) of SAFETEA LU, 23 U.S.C.§101. <br />The contractor shall not discriminate on the basis of race, color, national <br />origin, or sex in the performance of this contract. The contractor shall carry <br />out applicable requirements of 49 CFR Part 26 in the award and <br />administration of this FTA-assisted contract. Failure by the contractor to <br />carry out these requirements is a material breach of this contract, which <br />may result in the termination of this contract or such other remedy as <br />FDOT deems appropriate. Each subcontract the contractor signs with a <br />subcontractor must include the assurance in this paragraph. The <br />successful Bidder/offeror will be required to report its DBE participation <br />obtained through race-neutral means throughout the period of <br />performance. <br /> <br />Flow Down Requirements - The DBE contracting requirements flow down to all <br />third-party contractors and their contracts at every tier. Note that it is the FDOT’s <br />and prime contractor’s responsibility to ensure the DBE requirements are <br />applied across the board to all subrecipients/contractors/subcontractors. Should <br />a subcontractor fail to comply with the DBE regulations, FTA would look to the <br />FDOT to make sure it intervenes to monitor compliance.
