<br />(c) Exceptions. This clause does not prohibit contractors from <br />providing— <br /> <br />(1) A service that connects to the facilities of a third-party, such as <br />backhaul, roaming, or interconnection arrangements; or <br /> <br />(2) Telecommunications equipment that cannot route or redirect <br />user data traffic or permit visibility into any user data or packets <br />that such equipment transmits or otherwise handles. <br /> <br />(d) Reporting requirement. <br /> <br />(1) In the event the Contractor identifies covered <br />telecommunications equipment or services used as a substantial <br />or essential component of any system, or as critical technology <br />as part of any system, during contract performance, or the <br />Contractor is notified of such by a subcontractor at any tier or by <br />any other source, the Contractor shall report the information in <br />paragraph (d); <br /> <br />(2) (2) of this clause to the FDOT immediately. <br /> <br />Flow Down Requirements – This requirement flows down to all subcontracts at <br />every tier. <br /> <br />27. Bus Testing. <br /> <br />FDOT - 49 U.S.C. § 5318(e) and 49 C.F.R. part 665, FTA Master Agreement <br />FY2020 at Section 16(m) <br /> <br />Applicability - Rolling Stock, except minivans <br /> <br />Contractor shall comply with 49 USC A5323(c) and FTA's implementing <br />regulation 49 CFR part 665, to the extent they are consistent with 49 <br />U.S.C. § 5318(e), as amended; and shall perform the following: (1) A <br />manufacturer of a new bus model or a bus produced with a major change <br />in components or configuration shall provide a copy of the final test report <br />to the recipient prior to the recipient's final acceptance of the first vehicle. <br />(2) A manufacturer who releases a report under para. 1 above shall <br />provide notice to the operator of the testing facility that the report is <br />available to the public. (3) If the manufacturer represents that the vehicle <br />was previously tested, the vehicle being sold should have the identical <br />configuration and major components as the vehicle in the test report, <br />which must be provided to the recipient prior to the recipient's final <br />acceptance of the first vehicle.
