Geographic Information and Related Spatial Data. Any project activities <br />involving spatial data or geographic information systems activities financed with <br />Federal assistance are required to be consistent with the National Spatial Data <br />Infrastructure promulgated by the Federal Geographic Data Committee, except to <br />the extent that FTA determines otherwise in writing. <br /> <br />Geographic Restrictions. All project activities must be advertised without <br />geographic preference, (except in A/E under certain circumstances, preference <br />for hiring veterans on transit construction projects and geographic-based hiring <br />preferences as proposes to be amended in 2 CFR Part 1201). <br /> <br />In-State Bus Dealer Restrictions. The Recipient agrees that any state law <br />requiring buses to be purchased through in-state dealers will not apply to <br />purchases of vehicles supported with federal assistance appropriated or made <br />available for 49 U.S.C. chapter 53, as provided in 49 U.S.C. § 5325(i). <br /> <br />Organizational Conflicts of Interest. The Recipient agrees that it will not enter <br />into a procurement that involves a real or apparent organizational conflict of <br />interest described as follows: (1) When It Occurs. An organizational conflict of <br />interest occurs when the Project work, without appropriate restrictions on <br />certain future activities, results in an unfair competitive advantage: (a) To that <br />Third-Party Participant or another Third-Party Participant performing the Project <br />work, and (b) That impairs that Third-Party Participant’s objectivity in <br />performing the Project work, or (2) Other. An organizational conflict of interest <br />may involve other situations resulting in fundamentally unfair competitive <br />conditions, (3) Disclosure Requirements. Consistent with FTA policies, the <br />Recipient must disclose to FTA, and each of its Subrecipients must disclose to <br />the Recipient: (a) Any instances of organizational conflict of interest, or (b) <br />Violations of federal criminal law, involving fraud, bribery, or gratuity violations <br />potentially affecting the federal award, and (4) Failure to Disclose. Failure to <br />make required disclosures can result in remedies for noncompliance, including <br />debarment or suspension. <br /> <br />Project Labor Agreements. As a condition of a third-party contract award, the <br />Recipient may require the Third-Party Contractor or Subcontractor to have an <br />affiliation with a labor organization, such as a Project Labor Agreement, <br />consistent with Executive Order No. 13502, “Use of Project Labor Agreements <br />for Federal Construction Projects,” February 6, 2009 (74 Fed. Reg. 6985). <br /> <br />Force Account.
