3.10 COMPETENCE <br />Bidder shall provide evidence of technical and professional training in performing Janitorial <br />services in all commercial and governmental settings. Provide evidence in the area of cleaning <br />LEED certified buildings or green cleaning procedures; if none, so state. <br />3.11 SAFETY <br />The Bidder will be responsible for instructing its employees in safety measures considered <br />appropriate. Personnel will not place or use mops, brooms, or any equipment in traffic lanes or <br />other locations in such a manner as to create safety hazards. They will provide, place and remove <br />appropriate warnings signs for wet or slippery floors caused by cleaning or waxing operations (see <br />section 3.5(c)-vi). General safety requirements will be complied with in all activities. <br />All equipment shall be maintained in an efficient and safe operating condition while performing <br />work under the contract. Equipment shall have all proper safety devices required by law, properly <br />maintained, and in use at all times. If equipment does not contain proper safety devices and/or is <br />being operated in an unsafe manner, the City may direct the Contractor to remove such <br />equipment and/or the operator until the deficiency is corrected to the satisfaction of the City of <br />Sunny Isles Beach. The Contractor shall be solely responsible and liable for injury to persons, <br />and/or property damage caused by operation of the equipment. <br />3.12 ADHERENCE TO LAWS <br />The successful bidder shall be in compliance with all OSHA and other local, state and Federal <br />requirements. This includes compliance with OSHA Act #1910-1030 regarding worker exposure to <br />blood borne pathogens. Failure of the Contractor or their employees to comply with all applicable <br />laws, regulations and rules shall permit the City to immediately terminate this Contract without <br />liability or obligations. <br />3.13 REPORTING HAZARDOUS CONDITIONS AND ITEMS FOR REPAIR <br />The Bidder or his employees shall report any hazardous conditions and items in need of repair <br />including burnt out light bulbs, leaky faucets, toilet stoppages, etc. to the City’s Contract <br />Administrator. <br />3.14 TERMINATION <br />The City may, by written notice to the contractor, terminate the contract if the contractor has <br />been found to have failed to perform its services in a manner satisfactory to the City as per <br />specifications. The date of termination shall be stated in the notice. The City shall be the sole <br />judge of non-performance. <br />END OF SECTION <br /> <br />
