RESOLUTION NO. 2024 - 3 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, EXPRESSING OPPOSITION TO FLORIDA SENATE BILL 684 AND FLORIDA <br />HOUSE BILL 267 RELATING TO THE STANDARDS AND TIMEFRAMES FOR THE <br />ISSUANCE OF BUILDING PERMITS BY LOCAL GOVERNMENTS; DIRECTING THE <br />CITY CLERK TO TRANSMIT COPIES OF THIS RESOLUTION; AUTHORIZING THE CITY <br />MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, Florida Senate Bill 684 introduced by Senator DiCeglie, and its companion <br />House Bill 267 (collectively the "Bills") introduced by Representative Esposito, propose revisions <br />to the process of issuing building permits for residential subdivisions; and <br />WHEREAS, these bills mandate the creation of an expedited approval process for large- <br />scale residential developments, including a two-step application process for the adoption of a <br />preliminary and final plat, potentially affecting the thoroughness of municipal building, planning, <br />and zoning evaluations; and <br />WHEREAS, the requirement for municipalities to issue no less than 50% of the permits <br />upon an applicant's request may lead to hurried and careless review of development and <br />construction projects, conflicting with the city's goals for controlled and responsible growth; and <br />WHEREAS, the Bills further propose significant revisions to the timeframe and procedures <br />for building permit applications, including the reduction of the municipal authority to request <br />additional information and the "deeming" of applications as approved if specific timeframes are <br />not met, which could undermine a municipality's ability to ensure compliance with local codes <br />and development standards; and <br />WHEREAS, the Bills contain a provision that may reduce the permit fee by 75% if an owner <br />retains a private provider, a measure at the expense of municipal resources and oversight; and <br />WHEREAS, the imposition of such requirements without adequate consideration for local <br />conditions, resources, and governance structures poses a significant challenge to the City of <br />Sunny Isles Beach's (the "City") ability to manage its developmental trajectory effectively; and <br />WHEREAS, the City Commission finds that it is in the best interest of its residents to <br />oppose these Bills. <br />NOW, THEREFORE, BE RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1.
