City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 phone (305) 949-3113 Fax <br />include a minimum three (3) year discovery (tail) reporting period, and a retroactive date <br />that equals or precedes the effective date of the Contract, or the performance of Work <br />hereunder. In the event the policy is cancelled, non -renewed, switched to an occurrence <br />form, retroactive date advanced, or any other event triggering the right to purchase a <br />supplemental extended reporting period (SERP) during the life of this Contractor, <br />Contractor agrees to purchase a SERP with a minimum reporting period not less than two <br />(2) years. The requirement to purchase a SERP shall not relieve Contractor of the obligation <br />to provide replacement coverage. The Contractor agrees the Self -Insured -Retention shall <br />not exceed $25,000. This coverage may be provided on a Per -Project Basis. The Third - <br />Party Pollution Legal and Remediation Liability shall be endorsed to include City as an <br />Additional Insured. Worker's Compensation Insurance & Employers Liability. Contractor <br />agrees to maintain Worker's Compensation Insurance & Employers Liability in accordance <br />with Florida Statutes Chapter 440. <br />Waiver of Subrogation. Contractor agrees by entering into this Contract to a Waiver of <br />Subrogation for each required policy herein. When required by the insurer, or should a <br />policy condition not permit Contractor to enter into a pre -loss agreement to waive <br />subrogation without an endorsement, then Contractor agrees to notify the insurer and <br />request the policy be endorsed with a Waiver of Transfer of Rights of Recovery Against <br />Others, or its equivalent. This Waiver of Subrogation requirement shall not apply to any <br />policy, which includes a condition specifically prohibiting such an endorsement, or voids <br />coverage should Contractor enter into such an agreement on a pre -loss basis <br />Umbrella or Excess Liability. Contractor agrees to maintain either a Commercial Umbrella <br />or Excess Liability at a limit of liability not less than $1,000,000 Each Occurrence <br />$2,000,000 Aggregate. The Contractor agrees to endorse the City as an "Additional <br />Insured" on the Commercial Umbrella/Excess Liability, unless the Certificate of Insurance <br />states the Commercial Umbrella/Excess Liability provides coverage on a pure/true follow - <br />form basis, or the City is automatically defined as an Additional Protected Person. <br />Insurance required of the Contractor shall be primary to, and not contribute with, any insurance <br />or self-insurance maintained by the City. Such insurance shall not diminish Contractor's <br />indemnification and obligations hereunder. The insurance policy shall be issued by companies <br />authorized to do business under the laws of the State of Florida and acceptable to the City with <br />a minimum A.M. Best rating of A -Excellent. Before any work under this Agreement is <br />performed, and at any time upon request, Contractor shall furnish to the City certificates of <br />insurance evidencing the minimum required coverage and shall be appropriately endorsed for <br />contractual liability, with the City named as additional insured. All policies shall contain a <br />waiver of subrogation endorsement. All policies and certificates shall be in forms and issued <br />by insurance companies acceptable to the City Manager or his designee. All insurance policies <br />and certificates of insurance shall provide that the policies may not be canceled or altered <br />without thirty (30) days prior written notice to the City. Contractor shall also require and <br />ensure that each of its sub -Contractors or sub -Contractors providing services hereunder (if any) <br />procures and maintains, until the completion of the services, insurance of the types and to the <br />limits specified herein. ANY EXCEPTIONS TO THE INSURANCE REQUIREMENTS <br />IN THIS SECTION MUST BE APPROVED IN WRITING BY THE CITY. <br />ADVANCED ROOFING, INC. <br />
