No such approval will be construed as making the City <br />a party to such subcontract, or subjecting the City to liability of any kind to any subcontractor. No <br />subcontractor will under any circumstances relieve the Respondent of its liability and obligation <br />under any resulting contract. Subcontractor is subject to the same contractual conditions as is the <br />Respondent. The successful firm shall be responsible for all payments to any sub-consultants and <br />shall maintain responsibility for all work related to the Project. <br /> <br />2.23 SUB-LEASE <br /> Awarded contractor shall not-sublease or otherwise convey any interest of any sort granted by <br /> this agreement to any person or persons whatsoever without prior written consent and approval <br /> by the city. <br /> <br />2.24 RELEASE OF LIABILITY <br /> <br />The Contractor shall release and discharge the City of Sunny Isles Beach from any and all liability <br />for loss of merchandise, goods, equipment or other property of the Contractor or his agents if <br />lost, damaged, or destroyed by fire, theft, rain, water, storm, riot, civil disobedience, vandalism, <br />or any other cause(s). The Contractor must provide, and have sole responsibility for, all security <br />measures, which may be required to protect his equipment, materials and facilities. <br /> <br />2.25 BACKGROUND CHECKS – LEVEL 2 <br /> <br />The successful Firm will be responsible for hiring the necessary personnel to conduct the specified <br />services and will comply with all federal, state, and local laws related to minimum wage, social <br />security, nondiscrimination, Americans with Disabilities Act (“ADA”), unemployment <br />compensation, and workers’ compensation. All staff assigned to this contract shall be required, at <br />their sole cost and expense, to pass a criminal background check prior to award of the contract. <br />The criminal background check shall consist of a Florida Department of Law Enforcement (“FDLE”) <br />Florida Crime Information Center/National Crime Information Center (“FCIC/NCIC”) criminal <br />records check. Any employee not meeting this requirement will not be permitted to work at any <br />City facility. The successful proposer shall be required to coordinate the criminal background <br />checks through the City by contacting Human Resources at 305-792-1708. The cost of the <br />fingerprints is $67.75 per person. <br /> <br />2.26 EMERGENCY/DISASTER PERFORMANCE <br /> <br />In the event of a hurricane or other emergency or disaster situation, the successful vendor may <br />provide the City with the commodities/services defined within the scope of this formal solicitation <br />at the price contained within vendor's response menu. Further, successful vendor shall <br />deliver/perform for the city on a priority basis during such times of emergency. ALL WORK SHALL <br />BE COMPLETED IN ACCORDANCE WITH FEMA REGULATIONS. <br /> <br />2.267 POLYSTYRENE (STYROFOAM) ADMINISTRATIVE POLICY: <br /> <br /> City Ordinance 2021-564 (“Polystyrene Ordinance”) prohibits individuals and temporary vendors <br />who are located on or operating on City Property or a City Facility, as defined therein, from
