Contract Clauses for Solicitation 47QSMD20R0001 Refresh Number 19 Contract Number: GS -07F -0031W <br />(3) The Contractor uses forced or indentured child labor in its mining, production, or <br />manufacturing processes. <br />(4) The Contractor has furnished under the contract end products or components that have been <br />mined, produced, or manufactured wholly or in part by forced or indentured child labor. (The <br />Government will not pursue remedies at paragraph (d)(2) or paragraph (d)(3) of this clause unless <br />sufficient evidence indicates that the Contractor knew of the violation.) <br />(d) Remedies. <br />(1) The Contracting Officer may terminate the contract. <br />(2) The suspending official may suspend the Contractor in accordance with procedures in FAR <br />subpart 9.4. <br />(3) The debarring official may debar the Contractor for a period not to exceed 3 years in <br />accordance with the procedures in FAR subpart 9.4. <br />End of clause <br />52.219-8 UTILIZATION OF SMALL BUSINESS CONCERNS (SEP <br />2023) <br />(a) Definitions. As used in this contract <br />HUBZone small business concern means a small business concern that meets the requirements <br />described in 13 CFR 126.200, certified by the Small Business Administration (SBA) and designated by <br />SBA as a HUBZone small business concern in the Dynamic Small Business Search (DSBS) and SAM. <br />"Service -disabled veteran -owned small business concern" — <br />(1) Means a small business concern— <br />(i) Not less than 51 percent of which is owned by one or more service -disabled <br />veterans or, in the case of any publicly owned business, not less than 51 percent <br />of the stock of which is owned by one or more service -disabled veterans; and <br />(ii) The management and daily business operations of which are controlled by <br />one or more service disabled veterans or, in the case of a service -disabled <br />veteran with permanent and severe disability, the spouse or permanent caregiver <br />of such veteran. <br />(2) Service -disabled veteran means a veteran, as defined in 38 U.S.C.101(2), with a <br />disability that is service -connected, as defined in 38 U.S.C.101(16). <br />Small business concern means a concern, including its affiliates, that is <br />independently owned and operated, not dominant in its field of operation and qualified <br />as a small business under the criteria and size standards in 13 CFR part 121, including <br />the size standard that corresponds to the NAICS code assigned to the contract or <br />subcontract <br />Small disadvantaged business concern, consistent with 13 CFR 124.1001, means a <br />small business concern under the size standard applicable to the acquisition, that - <br />(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR <br />124.105) by - <br />(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and <br />Page: 190 of 216 <br />277 <br />
