Contract Clauses for Solicitation 47QSMD20R0001 Refresh Number 19 Contract Number: GS -07F -0031W <br />(d) Pending final resolution of any dispute, the Contractor shall promptly comply with the decision of <br />the Contracting Officer. <br />552.229-70 FEDERAL, STATE, AND LOCAL TAXES (APR 1984) <br />The contract price includes all applicable Federal, State, and local taxes. No adjustment will be made to cover <br />taxes which may subsequently be imposed on this transaction or changes in the rates of currently applicable <br />taxes. However, the Government will, upon the request of the Contractor, furnish evidence appropriate to <br />establish exemption from any tax from which the Government is exempt and which was not included in the <br />contract price. <br />552.229-71 FEDERAL EXCISE TAX—DC GOVERNMENT <br />(SEP 1999) <br />If the District of Columbia cites an Internal Revenue Tax Exempt Certificate Number on orders placed under <br />this contract, the Contractor shall bill shipments to the District of Columbia at prices exclusive of Federal <br />excise tax and show the amount of such tax on the invoice. <br />552.232-23 ASSIGNMENT OF CLAIMS (SEP 1999) <br />Because this is a requirements or indefinite quantity contract under which more than one agency may place <br />orders, paragraph (a) of the Assignment of Claims clause (FAR 52.232-23) is inapplicable and the following <br />is substituted therefor: <br />In order to prevent confusion and delay in making payment, the Contractor shall not assign any claim(s) for <br />amounts due or to become due under this contract. However, the Contractor is permitted to assign separately <br />to a bank, trust company, or other financial institution, including any Federal lending agency, under the <br />provisions of the Assignment of Claims Act, as amended, 31 U.S.C. 3727, 41 U.S.C. 15 (hereinafter referred <br />to as "the Act"), all amounts due or to become due under any order amounting to $1,000 or more issued by <br />any Government agency under this contract. Any such assignment takes effect only if and when the assignee <br />files written notice of the assignment together with a true copy of the instrument of assignment with the <br />contracting officer issuing the order and the finance office designated in the order to make payment. Unless <br />otherwise stated in the order, payments to an assignee of any amounts due or to become due under any order <br />assigned may, to the extent specified in the Act, be subject to reduction or set-off. <br />52.223-7 NOTICE OF RADIOACTIVE MATERIALS (JAN 1997) <br />(a) The Contractor shall notify the Contracting Officer or designee, in writing, To be determined at the <br />task order level days prior to the delivery of, or prior to completion of any servicing required by this <br />contract of, items containing either (1) radioactive material requiring specific licensing under the <br />regulations issued pursuant to the Atomic Energy Act of 1954, as amended, as set forth in Title 10 of <br />the Code of Federal Regulations, in effect on the date of this contract, or (2) other radioactive material <br />not requiring specific licensing in which the specific activity is greater than 0.002 microcuries per gram <br />or the activity per item equals or exceeds 0.01 microcuries. Such notice shall specify the part or parts of <br />the items which contain radioactive materials, a description of the materials, the name and activity of <br />the isotope, the manufacturer of the materials, and any other information known to the Contractor <br />which will put users of the items on notice as to the hazards involved (OMB No. 9000-0107). <br />(b) If there has been no change affecting the quantity of activity, or the characteristics and composition <br />of the radioactive material from deliveries under this contract or prior contracts, the Contractor may <br />request that the Contracting Officer or designee waive the notice requirement in paragraph (a) of this <br />clause.
