Contract Clauses for Solicitation 47QSMD20R0001 Refresh Number 19 Contract Number: GS -07F -0031W <br />(e) The Government reserves the right to exercise one of the following options: <br />(1) Accept the Contractor's price increases as requested when all conditions of (b), (c), and (d) of <br />this clause are satisfied; <br />(2) Negotiate more favorable discounts from the new commercial prices when the total increase <br />requested is not supported; or, <br />(3) Remove the product(s) from contract involved pursuant to the Cancellation clause of this <br />contract, when the increase requested is not supported. <br />(f) The increased contract prices shall apply to delivery orders issued to the Contractor on or after the <br />effective date of the contract modification. <br />Note: Regulation 552.216-70 <br />The EPA Ceiling Limit for this clause is hereby established as 4% for the Human Capital <br />Category, 5% for the Professional Services Category, 5% for the Travel Category and 10% <br />for all other Large Categories. <br />NOTE: This clause does not apply to contracts participating in the Transactional Data <br />Reporting (TDR) Pilot. Please refer to clause 552.216-70 Deviation H. <br />52.223-9 ESTIMATE OF PERCENTAGE OF RECOVERED <br />MATERIAL CONTENT FOR EPA -DESIGNATED ITEMS <br />(MAY 2008) <br />(a) Definitions. As used in this clause# <br />Postconsumer material means a material or finished product that has served its intended use and <br />has been discarded for disposal or recovery, having completed its life as a consumer item. <br />Postconsumer material is a part of the broader category of "recovered material." <br />Recovered material means waste materials and by-products recovered or diverted from solid <br />waste, but the term does not include those materials and by-products generated from, and commonly <br />reused within, an original manufacturing process. <br />(b) The Contractor, on completion of this contract, shall# <br />(1) Estimate the percentage of the total recovered material content for EPA -designated item(s) <br />delivered and/or used in contract performance, including, if applicable, the percentage of <br />post -consumer material content; and <br />(2) Submit this estimate to X. <br />552.246-71 SOURCE INSPECTION BY GOVERNMENT (JUN 2009) <br />(a) Inspection by Government personnel. <br />(1) Supplies to be furnished under this contract will be inspected at source by the Government <br />before shipment from the manufacturing plant or other facility designated by the Contractor, <br />unless the Contractor is otherwise notified in writing by the Contracting Officer or a designated <br />representative. Notwithstanding the foregoing, the Government may perform any or all tests <br />contained in the contract specifications at a Government facility without prior written notice by <br />Page: 19 of 216 <br />106 <br />
