Contract Clauses for Solicitation 47QSMD20R0001 Refresh Number 19 Contract Number: GS -07F -0031W <br />(1) The Contractor shall include the substance of this clause, including this paragraph (f), in every <br />subcontract that exceeds $10,000 and will be performed wholly or partially in the United States, <br />unless exempted by the rules, regulations, or orders of the Secretary of Labor issued pursuant to <br />section 3 of Executive Order 13496 of January 30, 2009, so that such provisions will be binding <br />upon each subcontractor. <br />(2) The Contractor shall not procure supplies or services in a way designed to avoid the <br />applicability of Executive Order 13496 or this clause. <br />(3) The Contractor shall take such action with respect to any such subcontract as may be directed <br />by the Secretary of Labor as a means of enforcing such provisions, including the imposition of <br />sanctions for noncompliance. <br />(4) However, if the Contractor becomes involved in litigation with a subcontractor, or is <br />threatened with such involvement, as a result of such direction, the Contractor may request the <br />United States, through the Secretary of Labor, to enter into such litigation to protect the interests <br />of the United States. <br />52.204-9 PERSONAL IDENTITY VERIFICATION OF <br />CONTRACTOR PERSONNEL (JAN 2011) <br />(a) The Contractor shall comply with agency personal identity verification procedures identified in the <br />contract that implement Homeland Security Presidential Directive -12 (HSPD-12), Office of <br />Management and Budget (OMB) guidance M-05-24, and Federal Information Processing Standards <br />Publication (FIPS PUB) Number 201. <br />(b) The Contractor shall account for all forms of Govemment-provided identification issued to the <br />Contractor employees in connection with performance under this contract. The Contractor shall return <br />such identification to the issuing agency at the earliest of any of the following, unless otherwise <br />determined by the Government: <br />(1) When no longer needed for contract performance. <br />(2) Upon completion of the Contractor employee's employment. <br />(3) Upon contract completion or termination. <br />(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply <br />with these requirements. <br />(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all <br />subcontracts when the subcontractor's employees are required to have routine physical access to a <br />Federally controlled facility and/or routine access to a Federally -controlled information system. It shall <br />be the responsibility of the prime Contractor to return such identification to the issuing agency in <br />accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in <br />writing by the Contracting Officer. <br />52.204-4 PRINTED OR COPIED DOUBLE -SIDED ON <br />POSTCONSUMER FIBER CONTENT PAPER (MAY 2011) <br />(a) Definitions.
