Approach / Methodology <br /> <br />The Earnings Credit will be applied on your TD Bank account analysis statement to <br />offset fees incurred during the monthly cycle. <br /> <br />TD Bank does not offer pricing tied to a specific index. Our rates our bank managed <br />and subject to change at any time. <br /> <br />W. Fee Structure <br /> <br />Proposer is to complete ATTACHMENT A to include a comprehensive list of all fees associated <br />with the services being requested in this Request for Proposal (RFP). All per item charges will <br />remain fixed for the life of the contract and all optional renewal periods. However, in the <br />event that any customer of the Bank, having comparable deposits and transaction volumes, <br />negotiates a lower fee structure for these requested services or similar services, the Bank shall <br />notify the Finance Director within thirty (30) days and shall extend the lower negotiated rate <br />to the City retroactively to the first date the lower rate was offered to another customer. <br />Should the Bank fail to provide the City the lower negotiated rate within ninety (90) days, the <br />Bank shall be required to reimburse the City the difference between the amount the City was <br />charged under its original contract and the amount the City would have been charged under <br />the lower negotiated rate. <br /> <br />Please refer to Pricing and Fees section for full cost details. <br /> <br />X. Confirmations <br /> <br />The bank must agree to respond to audit confirmations and requests for data, at no charge, <br />as needed from the Finance Department or its auditors. Proposer will provide a name and <br />address for the audit confirmation letter. <br /> <br />TD Bank acknowledges the statement above. <br /> <br />Y. Continuous Service <br /> <br />The bank will maintain sufficient staff to support the City’s requirements on a continuing basis <br />without interruption of service. Severe or repeated breakdowns of service for this reason will <br />be cause for termination of the contract. The City requires that the bank designate one of its <br />cash management services personnel who will act as liaison with the City for matters <br />regarding its accounts. <br /> <br />TD will meet this request. <br /> <br />In the event that online capabilities and functionality for any service are temporarily <br />unavailable for any reason (power failures, etc.) or a disaster occurs within TD Bank's <br />or the City's electronic systems, mirrored data-backup data is housed off-site with a <br />secured third party. <br /> <br />TD Bank maintains backup processing. Site and capabilities are confidential to ensure <br />optimum security for processing in the event of a disaster.
