RESOLUTION NO. 2024- -36-1* <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN <br />AGREEMENT WITH SCHINDLER ELEVATOR CORPORATION, FOR THE <br />REPLACEMENT OF THE ELEVATORS LOCATED AT THE PEDESTRIAN OVERPASS <br />BRIDGE AT GATEWAY PARK, IN AN AMOUNT NOT TO EXCEED SEVEN HUNDRED <br />NINE THOUSAND FOUR HUNDRED THIRTY-SIX DOLLARS AND NO CENTS <br />($709,436.00), PROVIDED SAID AGREEMENT IS FIRST APPROVED AS TO FORM <br />AND LEGAL SUFFICIENCY BY THE CITY ATTORNEY; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER <br />AND THE CITY ATTORNEY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach (the "City") is in need of a contractor to replace <br />the elevators located at the pedestrian overpass bridge at Gateway Park (the "Services"); and <br />WHEREAS, Schindler Elevator Corporation (the "Contractor") is a certified and insured <br />company with the necessary experience to provide the desired Services; and <br />WHEREAS, pursuant to section 62-13(I) of the City's Code of Ordinances, purchases made <br />through intergovernmental cooperative purchasing arrangements or purchasing consortiums <br />organized as a corporation not for profit whose members are governmental entities, provided <br />that such cooperative purchasing arrangements or consortiums provide for a competitive <br />process to select a vendor arte exempt from the City's competitive bidding requirements; and <br />WHEREAS, the City will utilize the pricing and terms under Sourcewell Contract #080420- <br />SCH, with 10% discount applied; and <br />WHEREAS, the Contractor is willing and able to provide the City with the desired Services <br />pursuant to the pricing and terms and conditions; and <br />WHEREAS, the City Commission wishes to authorize the City Manager to negotiate and <br />execute an Agreement with the Contractor to provide the desired Services, in an amount not to <br />exceed Seven Hundred Nine Thousand Four Hundred Thirty -Six Dollars and No Cents <br />($709,436.00), which includes a contingency in the amount of Sixty -Four Thousand Four Hundred <br />Ninety -Four Dollars and No Cents ($64,494.00), provided said Agreement is first approved as to <br />form and legal sufficiency by the City Attorney. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Authorization Negotiate and Execute Agreement. The City Commission hereby <br />authorizes the City Manager to negotiate and execute an Agreement with Schindler Elevator <br />Corporation to replace the elevators located at the pedestrian overpass bridge at Gateway Park, <br />in an amount not to exceed Seven Hundred Nine Thousand Four Hundred Thirty -Six Dollars and <br />@BCL@6COBD70B.docx Page 1 of 2 166 <br />
