(Initials of Authorized Representative) <br />11.Profit as a Separate Element of Price <br />For purchases using federal funds in excess of one hundred fifty thousand dollars ($150,000), a participating <br />agency may be required to negotiate profit as a separate element of the price. See, 2 CFR 200.324(b). When <br />required by a participating agency, Supplier Partner agrees to provide information and negotiate with the <br />participating agency regarding profit as a separate element of the price for a particular purchase. However, <br />Supplier Partner agrees that the total price, including profit, charged by Supplier Partner to the participating <br />agency shall not exceed the awarded pricing, including any applicable discount, under Supplier Partner’s <br />Group Purchasing Agreement. <br />Does Bidder agree? _ Click or tap here to enter text. <br /> (Initials of Authorized Representative) <br />12.Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment <br />Vendor agrees that recipients and subrecipients are prohibited from obligating or expending loan or grant <br />funds to procure or obtain, extend or renew a contract to procure or obtain, or enter into a contract (or extend <br />or renew a contract) to procure or obtain equipment, services, or systems that uses covered <br />telecommunications equipment or services as a substantial or essential component of any system, or as <br />critical technology as part of any system from companies described in Public Law 115-232, section 889. <br />Telecommunications or video surveillance equipment or services produced or provided by an entity that the <br />Secretary of Defense, in consultation with the Director of the National Intelligence or the Director of the <br />Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise <br />connected to, the government of a covered foreign country are also prohibited. <br />Does Bidder agree? _ Click or tap here to enter text. <br /> (Initials of Authorized Representative) <br />13.Domestic preferences for procurements <br />For participating agency purchases utilizing Federal funds, Bidder agrees to provide proof, where applicable, <br />that the materials, including but not limited to, iron, aluminum, steel, cement, and other manufactured <br />products are produced in the United States. <br />“Produced in the United States” means, for iron and steel products, that all manufacturing processes, from <br />the initial melting stage through the application of coatings, occurred in the United States. <br />“Manufactured products” means items and construction materials composed in whole or in part of non- <br />ferrous metals such as aluminum; plastics and polymer-based products such as polyvinyl chloride pipe; <br />aggregates such as concrete; glass, including optical fiber; and lumber. <br />Does Bidder agree? _ Click or tap here to enter text. <br /> (Initials of Authorized Representative) <br /> <br />14.General Compliance and Cooperation with Members <br />In addition to the foregoing specific requirements, Vendor agrees, in accepting any purchase order from a <br />Member, it shall make a good faith effort to work with Members to provide such information and to satisfy <br />Page | 29 <br /> <br /> <br />
