City. The Performance and Payment Bond shall continue in effect through the contract term. The <br />bonds shall be with a surety company authorized to do business in the State of Florida and having <br />been in business with a record of successful continuous operation for at least five (5) years. <br />The Bond shall guarantee all work and materials furnished under the Contract including losses <br />resulting from defects in the materials or improper performance of Work under the Contract that may <br />appear or be discovered during performance of the Work or during any applicable warranty period <br />after completion of all Work, and for latent defects. <br />14.4 Non -Discrimination <br />14.4.1. The Contractor warrants and represents that all of its employees are treated equally <br />during employment without regard to race, color, national origin, sex, gender identity, sexual <br />orientation, age, disability/handicap, religion, family or income status. <br />14.5 Discriminatory Vendor List <br />14.5.1. Pursuant to Section 287.134, Florida Statutes, an entity or affiliate who has been <br />placed on the discriminatory vendor list may not submit a bid, proposal, or reply on a contract to <br />provide any goods or services to a public entity; may not submit a bid, proposal, or reply on a contract <br />with a public entity for the construction or repair of a public building or public work; may not submit <br />bids, proposals, or replies on leases of real property to a public entity; may not be awarded or perform <br />work as a contractor, supplier, subcontractor, or consultant under a contract with any public entity; <br />and may not transact business with any public entity. By execution of this Contract, Contractor <br />represents that it has not been placed on the discriminatory vendor list as provided in Section <br />287.134, Florida Statutes. <br />14.6 Public Entity Crimes <br />14.6.1. Pursuant to Section 287.133, Florida Statutes, a person or affiliate who has been <br />placed on the convicted vendor list following a conviction for a public entity crime may not submit <br />a bid, proposal, or reply on a contract to provide any goods or services to a public entity; may not <br />submit a bid, proposal, or reply on a contract with a public entity for the construction or repair of a <br />public building or public work; may not submit bids, proposals, or replies on leases of real property <br />to a public entity; may not be awarded or perform work as a contractor, supplier, subcontractor, or <br />consultant under a contract with any public entity; and may not transact business with any public <br />entity in excess of the threshold amount provided in s. 287.017 for CATEGORY TWO for a period <br />of 36 months following the date of being placed on the convicted vendor list. By execution of this <br />Contract, Contractor represents that it has not been placed on the convicted vendor list as provided <br />in Section 287.133, Florida Statutes. <br />14.7 Scrutinized Company <br />Pursuant to Florida Statutes Section 287.135, and subject to limited exceptions contained <br />therein, a company is ineligible to, and may not, bid on, submit a proposal for, or enter into or renew <br />a contract with an agency or local governmental entity for goods or services if at the time of bidding, <br />submitting a proposal for, or entering into or renewing a contract, the company is on the Scrutinized <br />Companies that Boycott Israel List or is engaged in the boycott of Israel.
