In connection with the implementation of this Project, CONTRACTOR shall not discriminate against any employee or applicant for employment because of race, color, creed, sex, disability, sexual preference, sexual identity or affinity, age, or national origin. CONTRACTOR agrees to take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, color, creed, sex, disability, sexual preference, sexual identity or sexual affinity, age, or national origin. Such action shall include, but not be limited to, the following: employment, upgrading, demotion or transfer, recruitment or recruitment advertising, layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. CONTRACTOR agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided setting forth the provisions of this nondiscrimination clause. CONTRACTOR further agrees to ensure that subcontractor(s), if any, will be made aware of and will comply with this nondiscrimination clause. 11.3!Title VI Civil Rights Act of 1964. CONTRACTOR shall assure compliance of itself and all subcontractors under this Project with all requirements of Title VI of the Civil Rights Act of 1964. 11.4!Drug free Workplace. CONTRACTOR shall comply with the terms of the State of Florida Drug free Workplace Requirements and execute a drug free workplace certification in the form attached hereto as Exhibit D. 11.5!Security Clearances workers and subcontractors who work physically at the Project site are subject to criminal background checks conducted by SHERIFF. Ongoing access to the Project site by these individuals is contingent upon successfully passing such background checks in quired picture identifications and security applications from all the aforementioned individuals. judgment poses a risk to public safety or the physical security of the Project site or the governmental building housing the Project site. ARTICLE 12 - MISCELLANEOUS 12.1!Execution Date. The date of execution of this Agreement shall mean the last day upon which it becomes fully executed by CONTRACTOR and SHERIFF. 12.2!Joint Preparation.
