4uM�( <br />FIFTH AMENDMENT TO THE AGREEMENT BETWEEN THE <br />CITY OF SUNNY ISLES BEACH AND LUKES' LANDSCAPING, INC., d /b /a/ <br />LUKES - SAWGRASS LANDSCAPE, INC., <br />CONTRACT NO. C1314 -089 <br />THIS FIFTH AMENDMENT to the Agreement between the City of Sunny Isles Beach <br />( "City ") and Luk —s' Landscaping; Inc., d/b /a/ Lukes- Sawgrass Landscape; Inc., ("Contractor ") <br />executed this %l day of fjCXp6ER— , 2014, is made a part of the original Agreement <br />between the parties dated August 21, 2012, ( "the Agreement ") between the City and Contractor <br />attached hereto as Attachment "B ", whose Federal Identification # is The City <br />and Contractor hereby agree as follows: <br />1. SERVICES TO BE PERFORiIN7ED: The Scope of Services, as set forth in Section Two of <br />the Agreement between the parties, is hereby amended to include additional services, as more <br />particularly described in Attachment "A ", a copy of which is attached hereto and made part hereof. <br />2. OPTION TO RENEW: The City hereby exercises its second optional one (1) year renewal <br />term, commencing from the date of approval of this Amendment by the City Commission and <br />terminating one year thereafter. <br />3. COST: The payment to the Contractor, as set forth in Section 5 of the Original Agreement, <br />is hereby amended to include additional compensation for the additional services to be performed, in <br />an amount not to exceed Eight Hundred Twenty Five Thousand Seven Hundred Fifty -Six Dollars <br />(5825,756.00), bringing the total contract to an amount not to exceed Two Million Six Hundred <br />Seventy -Seven Thousand Seven Hundred Sixty -Five Dollars ($2,677,765.00). <br />4. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, <br />all terms and conditions of the original Agreement between the parties, dated August 21, 2012, shall <br />remain in full force and effect. <br />5.
