RFP #:24-08-01 <br />Proposer: Midtown Towing of Miami, Inc. <br />12 - DELAY: <br />Midtown Towing shall respond to requests from the Police or Public Works Department within a reasonable <br />amount of time. Midtown Towing recognizes that our response time shall be thirty (30) minutes from the time of <br />receiving request for service. In the event of a delay, Midtown Towing will notify the Police Department of the <br />estimated time of delivery as well as the reason for the delay. Midtown Towing understands that the City of Sunny <br />Isles Beach retains the right to cancel a request for service and use the services of the next Permit Holder on the <br />rotation list as specified in the City's Administrative Regulations. <br />13 - REMOVING HAZARDS: <br />Upon arriving at an accident scene, Midtown Towing shall remove any hazards or debris from the street and <br />impound such vehicles as designated by the City code enforcement officer or police officer. Midtown Towing <br />understands that the officer on scene shall have the sole responsibility to determine when a vehicle should be <br />impounded and our tow truck operator shall abide by that individual's decision. <br />14 - IMPOUND REPORTS/OWNER NOTIFICATION: <br />Midtown Towing shall obtain a Vehicle Storage Receipt from the City code enforcement officer or City police <br />officer on the scene for each vehicle to be impounded. Midtown Towing shall not remove a vehicle from the scene <br />without receiving a copy of the Vehicle Storage Receipt. <br />If, at the time of impoundment, the name and address of the registered owner or lienholder, if any, is not <br />available, Midtown Towing will obtain the information from the Police Department and/or Auto Data Direct. We <br />will notify the registered owner, its agent, any lienholder and insurance company in writing via certified mail of the <br />location of the vehicle within seven (7) days from the date of storage, excluding Saturdays and Sundays. <br />In instances where the driver of an impounded vehicle is arrested, Midtown Towing shall notify the registered <br />Lessor or lienholder, via certified mail within seven (7) days from the date of storage, excluding Saturdays and <br />Sundays, as required by Florida Statute 322.34. Upon payment of any lawful towing or storage charges and with <br />the authorization of the Police Department, Midtown Towing shall release the vehicle to the registered Lessor or <br />lienholder. <br />If the state of registration is unknown, Midtown Towing shall make a good faith best effort to notify the owner and <br />any lien holders, and such notice shall be given within a reasonable period of time from the date of storage. "Good <br />Faith Best Effort" shall mean that the following procedure has been performed by Midtown Towing to establish <br />the prior state of registration and title: <br />A. Check vehicle for any type of tag, tag record, temporary tag or regular tag. <br />B. Check law enforcement report for tag number, if vehicle was towed at the request of a law enforcement <br />officer. <br />C. Check trip sheet or tow ticket of tow truck operator to see if a tag was on the vehicle at the beginning of <br />tow, if private tow; <br />D. If owner's address is not listed on the impound report, check law-enforcement report to see if an out-of- <br />state address is indicated from driver license information; <br />Midtown Towing of Miami, Inc. <br />647 <br />
