VIA EMAIL <br />August 25, 2023 <br />Ms. Amy Canales <br />Director of Planning and Zoning <br />City of Sunny Isles Beach <br />18070 Collins Avenue, 3rd Floor <br />Sunny Isles Beach, FL 33160 <br />11- OF <br />ISLES 9 <br />RECEIVED <br />8/25/2023 <br />PLANNING & ZONING DEPT. <br />Re: Application for Certificate of Appropriateness -334 Atlantic Avenue <br />Dear Ms. Canales: <br />On behalf of our clients, George Scholl and Dione Del Monico ("Owner" or <br />"Applicant"), the owners of 334 Atlantic Avenue in the City of Sunny Isles Beach (the <br />"Property"), we respectfully submit this letter of intent in support of an application to the <br />City of Sunny Isles Beach Historic Preservation Board ("Board") for issuance of a <br />certificate of appropriateness ("COA") to demolish the historically -designated residential <br />structure on the Property. <br />While Owner has no immediate plans for demolition and hopes to continue as a <br />steward of the structure for as long as Owner owns it,1 as further detailed below the current <br />conditions and realities of the structure's elevation, deterioration, and location on the <br />Property require the relief sought. <br />1 Owner originally sought to remove the individual historic site designation of the <br />structure so it did not have to immediately seek demolition, however, the City does not <br />have any criteria in its Code to remove historic designation and the criteria for listing a <br />structure as historic does not include structural deterioration, flooding, or sea -level related <br />issues. While Owner maintains that this lack of process is an unconstitutional infringement <br />on Owner's due process rights, and without waiving and legal rights to challenge that <br />process, Owner is proceeding with an application for a certificate of appropriateness for <br />demolition. <br />Page 14 of 98 25 <br />
