Page 6 of 6 <br />Satisfied: The variance is in furtherance of a temporary site plan for the <br />temporary installation of a sales center. The temporary nature of the use and <br />structure is not injurious to the neighborhood or detrimental to property <br />values. To the contrary, the improvement of the vacant site for the intended <br />purpose will enhance the neighborhood and improve property values. In <br />addition, the orientation of the proposed temporary structure will improve the <br />pedestrian experience on Collins Avenue. <br />IV. The Application Satisfies the SiEn Variance Criteria <br />Under section 265-63.1, City Code, a sign variance will be approved when: <br />(1) The variance is not contrary to the public interest; <br />The proposed signage currently exists on the St. Regis development site and was <br />previously found to not be contrary to the public interest via Resolution 23-3547. <br />(2) Special conditions and circumstances do not result from actions of the applicant; <br />No special conditions and circumstances exist in allowing the Sales Center to use <br />signage consistent with prior approvals. <br />(3) A literal enforcement of the provisions of this chapter may result in unnecessary <br />hardship <br />A literal enforcement of the provisions of the City Code would result in an <br />unnecessary hardship and may reduce project visibility. <br />The Application has satisfied the necessary criteria, and the Applicant respectfully requests <br />approval.
