Each progress payment shall be reduced by five percent (5%) retainage. Subject to other <br />requirements of the Contract Documents, retainage shall be released after final completion of the <br />Work and City’s receipt of acceptable reports and other documentation including certification of <br />payment to subcontractors, if any, and a Final Release of Lien in the form set forth in Section <br />713.20, Florida Statutes. <br /> <br />Bidder is advised that processing of invoices must follow this schedule, as the City has funding <br />requirements and other payment obligations which may prevent payment of late Statement of <br />Services for that month’s billing cycle. <br /> <br />2.13 DIRECT PURCHASE <br /> <br /> The City/Owner may, in its discretion, decide to directly purchase specific equipment or materials <br /> included in the Contractor’s bid in order to achieve sales tax savings. A change order will be issued <br /> to reduce the contract price for the direct purchase(s). Contractor will approve the material <br /> quantities and prices for the Purchase Order issued. Materials will be shipped as directed by the <br /> Contractor. Contractor will be responsible for storing and protection all direct purchase items. <br /> The direct purchase of materials and/or equipment by City/Owner does not relieve the Contractor <br /> of the responsibility to ensure that the equipment and material so purchased meets the <br /> specifications required for the work/project. All direct purchase equipment and materials shall be <br /> subject to the same warranties as any materials or equipment purchased or provided by <br /> Contractor. <br /> <br />2.14 COMPLIANCE WITH FEDERAL STANDARDS <br /> <br />All items to be purchased under this contract shall be in accordance with all governmental <br />standards, to include, but not be limited to, those issued by the Occupational Safety and <br />Health Administration (OSHA), the National Institute of Occupational Safety Hazards (NIOSH), <br />and the National Fire Protection Association (NFPA) and applicable provisions of the Americans <br />with Disabilities Act (ADA) in the course of providing any services. <br /> <br />2.15 PERMITS <br /> <br />The Contractor shall obtain and pay for all licenses, permits (please refer to permit fees here) and <br />inspection fees required for this Project; and shall comply with all laws, ordinances, regulations <br />and building code requirements applicable to the work contemplated herein. Damages, penalties <br />and or fines imposed on the City or the Contractor for failure to obtain required licenses, permits <br />or fines shall be borne by the Contractor. Contractor shall be required to furnish a certified copy <br />of all licenses, certificates of competency or other licensure requirements necessary to practice <br />his profession as required by Florida Statutes, Florida Building Code, Miami-Dade County, or City <br />of Sunny Isles Beach Code. These documents shall be furnished to the City along with the Bid <br />response. Failure to furnish these documents or to have required licensure will be grounds for <br />rejecting the Bid as non-responsive or otherwise. <br />
