If the Contractor <br />transfers all public records to the City upon completion of the Contract, the Contractor <br />shall destroy any duplicate public records that are exempt or confidential and exempt from <br />public records disclosure requirements. If the Contractor keeps and maintains public <br />records upon completion of the Contract, the Contractor shall meet all applicable <br />requirements for retaining public records. All records stored electronically must be <br />provided to the City, upon request from the City's custodian ofpublic records, in a format <br />that is compatible with the information technology systems of the City. If the Contractor <br />fails to comply with the requirements in this Section, the City may enforce these <br />provisions in accordance with the terms of this Agreement. If the Contractor fails to <br />provide the public records to the City within a reasonable time, it may be subject to <br />penalties under Section 119.10, Florida Statutes. <br />IF THE CONTRACTOR HAS QUESTIONS REGARDING THE APPLICATION <br />OF CHAPTER 119, FLORIDA STATUTES, TO THE CONTRACTOR'S DUTY TO <br />PROVIDE PUBLIC RECORDS RELATING TO THIS CONTRACT, THE <br />CONTRACTOR SHOULD CONTACT THE CITY'S CUSTODIAN OF PUBLIC <br />RECORDS: THE CITY CLERK, MAURICIO BETANCUR, BY TELEPHONE <br />(305/792-1703), E-MAIL (MBETANCUR@SIBFL.NET), OR MAIL (CITY OF <br />SUNNY ISLES BEACH, OFFICE OF THE CITY CLERK, 18070 COLLINS <br />AVENUE, SUNNY ISLES BEACH, FLORIDA 33160). <br />Compliance with Laws <br />1.8.1 Contractor and the Services must comply with all applicable federal, state, <br />and local laws, codes, ordinances, rules, and regulations including, without limitation, <br />the American with Disabilities Act (ADA), 42 U.S.C. § 12101, Section 504 of the <br />Rehabilitation Act of 1973, and any related federal, state, or local laws, rules, and <br />regulations. <br />1.8.2 ADA Compliance <br />Upon request, Contractor will provide the City with any accessibility testing results <br />and written documentation verifying accessibility for documents delivered by the <br />Contractor to the City, as well as promptly respond to and resolve accessibility <br />complaints. <br />Electronic Recordkeeping <br />1.9.1 Contractor certifies its services and products meet all recordkeeping <br />requirements of the State of Florida, including but not limited to those in Chapter 119, <br />Florida Statutes, and Rule 1B -26.003(6)(g), Florida Administrative Code. <br />COMTECH ENGINEERING, INC. <br />
