ENROLLED <br />2025 Legislature <br />SB 2-C <br />20252Cer <br />320 (5)+4-} Notwithstanding any other provision of this chapter, <br />321 if a licensee established his or her identity for a driver <br />322 license using an identification document authorized under s. <br />323 322.08(2)(c)7. or 8., the licensee may not change his or her <br />324 name or address except in person and upon submission of an <br />325 identification document authorized under s. 322.08(2)(c)7. or 8. <br />326 Section 9. Section 775.0824, Florida Statutes, is created <br />327 to read: <br />328 775.0824 Dangerous unauthorized alien offender; legislative <br />329 intent; definitions; mandatory minimum prison terms. - <br />330 (1) It is the intent of the Legislature that dangerous <br />331 unauthorized alien offenders be punished to the fullest extent <br />332 of the law and as provided in this section. <br />333 (2) As used in this section, the term: <br />334 (a) "Dangerous unauthorized alien offender" means an <br />335 unauthorized alien who is a member of a criminal gang as defined <br />336 in s. 874.03, and who commits or attempts to commit a felony <br />337 offense in this state. <br />338 (b) "Unauthorized alien" has the same meaning as in s. <br />339 908.111. <br />340 (3) For an offense committed on or after the effective date <br />341 of this act, if the state attorney determines that a person is a <br />342 dangerous unauthorized alien offender, the state attorney shall <br />343 seek to have the court sentence the person as a dangerous <br />344 unauthorized alien offender. In a separate proceeding conducted <br />345 pursuant to this section, upon proof from the state attorney <br />346 that establishes that the person is a dangerous unauthorized <br />347 alien offender, such person is not eligible for sentencing under <br />348 the sentencing guidelines and must be sentenced as follows: <br />Page 12 of 51 <br />CODING: Words stLcieken are deletions; words underlined are additions. 245 <br />
