ENROLLED <br />2025 Legislature <br />SB 2-C <br />20252Cer <br />987 good faith or upon advice of counsel. <br />988 (b) If the court determines that a violation was knowing <br />989 and willful, the court must assess a civil fine of up to $5,000 <br />990 against the elected or appointed local government official or <br />991 officials or administrative agency head under whose jurisdiction <br />992 the violation occurred. <br />993 (c) Except as required by applicable law, public funds may <br />994 not be used to defend or reimburse the unlawful conduct of any <br />995 person found to have knowingly and willfully violated this <br />996 subsection. <br />997 Section 21. Subsection (1) of section 908.107, Florida <br />998 Statutes, is amended to read: <br />999 908.107 Enforcement. - <br />1000 (1) Any executive or administrative state, county, or <br />1001 municipal officer who violates his or her duties under this <br />1002 chapter may be subject to action by the Governor, including <br />1003 potential suspension from office, in the exercise of his or her <br />1004 authority under the State Constitution and state law. Pursuant <br />1005 to s. 1(b), Art. IV of the State Constitution, the Governor may <br />1006 initiate judicial proceedings in the name of the state against <br />1007 such officers to enforce compliance with any duty under this <br />1008 chapter or restrain any unauthorized act contrary to this <br />1009 chapter. <br />1010 Section 22.
