In addition, 281 <br />the contractor must agree to defend, hold harmless, and 282 <br />indemnify the department against any and all actions, claims, 283 <br />damages and losses, including costs and attorney attorney's 284 <br />fees. 285 <br /> Section 3. For the purpose of incorporating the amendment 286 <br />made by this act to section 768.28, Florida Statutes, in a 287 <br />reference thereto, subsection (5) of section 45.061, Florida 288 <br />Statutes, is reenacted to read: 289 <br /> 45.061 Offers of settlement.— 290 <br /> (5) Sanctions authorized under this section may be imposed 291 <br />notwithstanding any limitation on recovery of costs or expenses 292 <br />which may be provided by contract or in other provisions of 293 <br />Florida law. This section shall not be construed to waive the 294 <br />limits of sovereign immunity set forth in s. 768.28. 295 <br /> Section 4. For the purpose of incorporating the amendment 296 <br />made by this act to section 768.28, Florida Statutes, in a 297 <br />reference thereto, subsection (4) of section 110.504, Florida 298 <br />Statutes, is reenacted to read: 299 <br /> 110.504 Volunteer benefits.— 300
