For the purpose of incorporating the amendment 1355 <br />made by this act to section 768.28, Florida Statutes, in a 1356 <br />reference thereto, paragraph (b) of subsection (11) of section 1357 <br />472.006, Florida Statutes, is reenacted to read: 1358 <br /> 472.006 Department; powers and duties.—The department 1359 <br />shall: 1360 <br /> (11) Provide legal counsel for the board by contracting 1361 <br />with the Department of Legal Affairs, by retaining private 1362 <br />counsel pursuant to s. 287.059, or by providing department staff 1363 <br />counsel. The board shall periodically review and evaluate the 1364 <br />services provided by its board counsel. Fees and costs of such 1365 <br />counsel shall be paid from the General Inspection Trust Fund, 1366 <br />subject to ss. 215.37 and 472.011. All contracts for independent 1367 <br />legal counsel must provide for periodic review and evaluation by 1368 <br />the board and the department of services provided. 1369 <br /> (b) Any person retained by the department under contract 1370 <br />to review materials, make site visits, or provide expert 1371 <br />testimony regarding any complaint or application filed with the 1372 <br />department relating to the practice of surveying and mapping 1373 <br />shall be considered an agent of the department in determining 1374 <br />the state insurance coverage and sovereign immunity protection 1375
