14.4 Non -Discrimination
<br />14.4.1. The Contractor agrees to comply with all local and state civil rights ordinances and
<br />with Title VI of the Civil Rights Act of 1984 as amended, Title VIII of the Civil Rights Act of 1968 as
<br />amended, Title 1 of the Housing and Community Development Act of 1974 as amended, Section
<br />504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, the Age
<br />Discrimination Act of 1975, Executive Order 11063, and with Executive Order 11248 as amended
<br />by Executive Orders 11375 and 12086. The Contractor will not discriminate against any employee
<br />or applicant for employment because of race, color, creed, religion, ancestry, national origin, sex,
<br />disability or other handicap, age, marital/familial status, or status with regard to public assistance.
<br />The Contractor will take affirmative action to insure that all employment practices are free from
<br />such discrimination. Such employment practices include but are not limited to the following:
<br />hiring, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, termination,
<br />rates of pay or other forms of compensation, and selection for training, including apprenticeship.
<br />The Contractor agrees to post in conspicuous places, available to employees and applicants for
<br />employment, notices to be provided by the City setting forth the provisions of this non-
<br />discrimination clause. The Contractor agrees to comply with any Federal regulations issued
<br />pursuant to compliance with Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 708), which
<br />prohibits discrimination against the handicapped in any Federally assisted program.
<br />14.5 Discriminatory Vendor List
<br />14.5.1. Pursuant to Section 287.134, Florida Statutes, an entity or affiliate who has been
<br />placed on the discriminatory vendor list may not submit a bid, proposal, or reply on a contract to
<br />provide any goods or services to a public entity; may not submit a bid, proposal, or reply on a
<br />contract with a public entity for the construction or repair of a public building or public work; may
<br />not submit bids, proposals, or replies on leases of real property to a public entity; may not be
<br />awarded or perform work as a contractor, supplier, subcontractor, or consultant under a contract
<br />with any public entity; and may not transact business with any public entity. By execution of this
<br />Contract, Contractor represents that it has not been placed on the discriminatory vendor list as
<br />provided in Section 287.134, Florida Statutes.
<br />14.6 Public Entity Crimes'
<br />14.6.1. Pursuant to Section 287.133, Florida Statutes, a person or affiliate who has been
<br />placed on the convicted vendor list following a conviction for a public entity crime may not submit
<br />a bid, proposal, or reply on a contract to provide any goods or services to a public entity; may not
<br />submit a bid, proposal, or reply on a contract with a public entity for the construction or repair of
<br />a public building or public work; may not submit bids, proposals, or replies on leases of real
<br />property to a public entity; may not be awarded or perform work as a contractor, supplier,
<br />subcontractor, or consultant under a contract with any public entity; and may not transact business
<br />with any public entity in excess of the threshold amount provided in s. 287.017 for CATEGORY TWO
<br />for a period of 36 months following the date of being placed on the convicted vendor list. By
<br />execution of this Contract, Contractor represents that it has not been placed on the convicted
<br />vendor list as provided in Section 287.133, Florida Statutes.
