A report <br />to the Contractor (per Section 7.4) will be submitted along with the unsatisfactory inspection <br />notice. The deductions include: <br /> <br />1. Performance deficiency. Examples include: failure to comply with conditions, specifications, <br />reports, schedules and/or directives from Authorized Representatives and Purchase Order; failure <br />to adequately remove trash/debris/weeds in a timely manner, apply chemicals, prune, etc. failure <br />to follow FDOT regulations. Deduction may be based upon costs provided by the Contractor on <br />the Bid Worksheets submitted at the time of bid or as deemed appropriate by the Authorized <br />Representative. Deduction of up to $200 per instance. <br /> <br />2. Failure to comply with minimum City defined manpower requirements. Deduction of $100 per <br />employee per workday. <br /> <br />3. Failure to provide adequate equipment in compliance with City specifications and/or as <br />requested by the Authorized Representative. May result in a deduction of up to $200 per <br />instance per workday. <br /> <br />4. Failure to protect public health and/or correct safety concerns. These include, but are not <br />limited to, policing City property for hazards, responding to emergencies, providing adequate <br />traffic control measures (per M.U.T.C.D. Guidelines). May result in a deduction of up to $250 per <br />occurrence. <br /> <br /> 5. Failure to comply with water restrictions imposed by any agency having authority to do so. <br />May result in a deduction of up to $250 per occurrence. Additionally, Contractor shall be <br />responsible for any imposed penalties. <br /> <br />6. Major irrigation deficiencies shall be repaired within 12 hours and are subject to a deduction <br />up to $250 per occurrence. <br /> <br />2.39 LABOR, MATERIALS, AND EQUIPMENT SHALL BE SUPPLIED BY THE BIDDER <br /> <br />Unless otherwise provided in Section 3 entitled "Performance Standards and Technical <br />Specifications", of this solicitation the Bidder shall furnish all labor, material, equipment and <br />supplies necessary for satisfactory contract performance. When not specifically identified in the <br />technical specifications, such materials and equipment shall be of a suitable type and grade <br />customarily used for the purpose. All power operating equipment, trucks, lawn mowers, tractors, <br />etc., and all hand or vehicular tools must be operated within the safety parameter as defined by <br />the manufacturer and OSHA; and, must be carefully maintained and operated with proper safety <br />guards and devices and with discretion when near the public and vehicular traffic. All material, <br />workmanship, and equipment shall be subject to the inspection and approval of the Project <br />Manager(s). <br /> <br />2.40 LICENSES, PERMITS AND FEES <br /> <br />The bidder shall obtain and pay for all licenses, permits and inspection fees required for this <br />project; and shall comply with all laws, ordinances, regulations and building code requirements
