Any change in schedule due to <br />this section must be communicated to the Project Manager prior to the commencement of work. <br />This shall apply throughout this entire ITB. <br /> <br />2.45 REMOVAL OF SERVICES <br /> <br />This contract includes all types of services that the City MAY elect the Bidder to provide. As such, <br />it is hereby agreed and understood that the City may remove service or reduce quantity of items <br />and/or frequency of service during the contract period with seven (7) calendar days notice to the <br />Bidder. It shall also be understood that the cost of any services that are not provided by the <br />contractor are not subject to the unit prices outlined in Section 6 of the ITB response. The City <br />will only pay for services that have been requested and at the adjusted final price as outlined in <br />Section 6 of this ITB response. In the event that a site not listed herein is added to the Contract, <br />the Bidder shall invoice the same amount as prices quoted herein for similar service(s). <br /> <br />2.46 OTHER GOVERMENTAL AGENCIES: <br /> <br /> 2.51.1 All bidders awarded contracts for this bid may, upon mutual agreement with other <br /> agencies, permit any school district/board, municipality or other governmental agency to <br /> participate in the contract under the same price terms and conditions, if agreed to by both parties. <br /> <br /> 2.51.2 Further to paragraph 2.51.1, it is understood that each school district/board, municipality <br /> or agency will issue its own Purchase Order to the awarded bidder(s). <br /> <br />2.51.3 It is understood and agreed that the City is not in any way a legal party to any contractual <br />agreement made between any other government unit or educational organization and the <br />Awarded Bidder(s) as a result of this ITB. <br /> <br />2.47 PUBLIC RECORDS <br /> <br />IF THE SUCCESSFUL PROPOSER HAS QUESTIONS REGARDING <br />THE APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO <br />THE SUCCESSFUL PROPOSER’S DUTY TO PROVIDE PUBLIC <br />RECORDS RELATING TO THIS AGREEMENT, CONTACT THE <br />CUSTODIAN OF PUBLIC RECORDS AT CITY OF SUNNY ISLES <br />BEACH 18070 COLLINS AVENUE, SUNNY ISLES BEACH, FL <br />33160.
