RESOLUTION NO. 2025 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A FIRST AMENDMENT TO THE AGREEMENT WITH KVP <br />ENTERPRISES, INC., d/b/a EXPERT DIESEL FOR SERVICES AND REPAIR OF CITY'S <br />BUSES WITH DIESEL ENGINES, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED <br />TWENTY THOUSAND DOLLARS AND NO CENTS ($120,000.00), ATTACHED <br />HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID <br />AMENDMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, the City of Sunny Isles Beach (the "City") was in need of a contractor to <br />service and repair the City's buses with diesel engines, including warranty and non -warranty <br />work and parts replacement (the "Services"); and <br />WHEREAS, on October 3rd, 2024, the City Manager executed an Agreement with KVP <br />Enterprises, Inc. d/b/a Expert Diesel (the "Contractor") to provide the City with the desired <br />Services, in an amount not to exceed $40,000.00, for an initial term of a one (1) year, with a one <br />(1) year renewal option; and <br />WHEREAS, Contractor is a certified and insured company with the necessary experience <br />to provide the desired Services; and <br />WHEREAS, Miami -Dade County issued Invitation to Quote ("IT(X") No. PM-EVN0002338, <br />entitled "Purchase of OEM Parts/Supplies/Repairs/Service," and on or about October 10, 2023, <br />Miami -Dade County awarded various contractors, including Contractor, a contract for a three <br />(3) year term, up through and including October 9, 2026; and <br />WHEREAS, pursuant to section 62-13(C) of the City's Code of Ordinances, purchases <br />made under state, county or other governmental contracts, or competitive bids with other <br />governmental agencies are exempt from the City's competitive bidding procedures; and <br />WHEREAS, the City Commission wishes to approve the First Amendment to the <br />Agreement with the Contractor to provide the desired Services, in an amount not to exceed <br />One Hundred Twenty Thousand Dollars and No Cents ($120,000.00), bringing the total contract <br />amount not to exceed One Hundred Sixty Thousand Dollars and No Cents ($160,000.00), <br />attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of First Amendment. The City Commission hereby approves the First <br />Amendment to the Agreement with the Contractor to provide the desired Services, in an <br />amount not to exceed One Hundred Twenty Thousand Dollars and No Cents ($120,000.00), <br />@BCL@FOOF77C5.doc Page 1 of 2 143 <br />
