WHEREAS, after conducting a due diligence review of available resources, and in an effort <br />to maintain consistency and continuity in products, the City Manager has determined that it is in <br />the best interest of the City to waive the bidding requirements set forth in Chapter 62 of the City's <br />Code for purchase of the Open Market Items only; and <br />WHEREAS, the City Commission wishes to authorize the City Manager to negotiate and <br />execute an Agreement with the Vendor to provide the desired Services, including the Open Market <br />Items, in an amount not to exceed One Hundred Fifty Thousand Dollars and No Cents <br />($150,000.00), which includes a contingency in the amount of Fifty -One Thousand One Hundred <br />Dollars and Forty -Four Cents ($51,100.44), provided said Agreement is first approved as to form <br />and legal sufficiency by the City Attorney. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Waiver of Bidding Requirements. The City Commission hereby waives the bidding <br />requirements set for in Chapter 62 of the City's Code as it relates to the Open Market Items only. <br />Section 2. Authorization of the City Manager and City Attorney. The City Manager is hereby <br />authorized to negotiate and execute an Agreement with the Vendor to provide the desired <br />Services, in an amount not to exceed One Hundred Fifty Thousand Dollars and No Cents <br />($150,000.00), which includes a contingency in the amount of Fifty -One Thousand One Hundred <br />Dollars and Forty -Four Cents ($51,100.44), provided said Agreement is first approved as to form <br />and legal sufficiency by the City Attorney. The City Manager and City Attorney are further <br />authorized to do all things necessary to effectuate the terms of this Resolution. <br />Section 3. Effective Date.
