components, site amenities, concrete and/or asphalt surfaces, vehicles, structures, sidewalks, <br />curbs and gutters, driveways, utilities, etc. Contractor must provide protection necessary to <br />prevent damage to property being repaired or replaced. If the work site has any pre-existing <br />damage, the Contractor shall notify the Public Works/Capital Projects Department in writing. <br />Failure to do so shall obligate the contractor to make repairs per the above section. <br />2.18 VEHICLE IDENTIFICATION AND PERSONELL UNIFORM/APPEARANCE <br />The Contractor shall at all times keep the premises free from accumulation of waste materials or <br />rubbish caused by his employees or the Work. Upon final completion of the Work and before <br />acceptance and final payment shall be made, the Contractor shall clean and remove from the site <br />and adjacent property, all surplus and discarded materials, rubbish, and temporary structures. <br />The Contractor shall restore in an acceptable manner all property which, has been damaged <br />during the execution of the work. The Contractor shall leave the site and vicinity unobstructed in <br />a neat and presentable condition throughout the entire area. <br />The Contractor shall properly dispose, at its own cost, of any waste resulting from the work being <br />performed in an approved facility at an approved site unless otherwise specified in this document. <br />2.19 EMPLOYEE TRAINING/OPERATING OF EQUIPMENT <br />The Contractor must ensure that all employees have been properly trained, certified, and/or <br />licensed to operate power equipment, power and mechanical tools, and must maintain records <br />of all training, qualifications and certifications to be made available for the City's review upon <br />request. The Contractor must provide training to all employees, at Contractor's expense, to <br />ensure the competencies in performing tasks are met to prevent the endangerment of personnel <br />or the public. Employees must not be permitted to use radios, cell phones, texting devices, mp3 <br />players, or other media devices, while operating equipment and may be subject to removal from <br />the Work site for repeated violations. Employees are prohibited from smoking during <br />performance of the Work under this Contract. <br />2.20 LIQUIDATED DAMAGES <br />Failure to mobilize and complete all the work within the time specified by the city's Project <br />Manager, including any extension granted in writing by the City, shall obligate the Contractor to <br />pay the City, as liquidated damages and not as a penalty, an amount equal to two -hundred <br />Dollars ($200) for each calendar day of delay in the completion of all the work. If any liquidated <br />damages are unpaid by the Contractor, the City shall be entitled to deduct these unpaid liquidated <br />damages from the monies due the Contractor. <br />2.22 PUBLIC RECORDS LAW <br />The City is subject to Chapter 119, Florida Statutes, "Public Records Law." No claim of <br />confidentiality or proprietary information in all or any portion of a response will be honored unless <br />a specific exemption from the Public Law exists and is cited in the response.
