Samson Commission Chambers, Sunny Isles Beach Government Center, 18070 Collins Avenue, Sunny <br />Isles Beach, Florida on THURSDAY, April 17, 2025 AT 6:30 P.M., to consider the following Zoning application: <br />Public Hearing #: PZ2025-04 <br />Application: Variances for a New Single -Family Home <br />Applicant: Yehuda Gabay <br />Property Location: 201 189 Terrace, Sunny Isles Beach, FL 33160 <br />Size of Property: 7,933 sq. ft. (0.18 acres) <br />Zoning District: R-1 (Single -Family Residential) <br />Summary: The Applicant, owner of the property located at 201 189 Terrace, is seeking approval for variances in relation to <br />the construction of a new single-family home. The requested variances would allow the home to face Atlantic Boulevard instead <br />of 189 Terrace, reduce the street side yard setback for a pool, and allow roof overhang encroachments into the front, street side, <br />side, and rear yards. <br />Request: <br />1. Pursuant to Section 265-5 of the City of Sunny Isles Beach Land Development Regulations, the Applicant requests a <br />variance from the application of the definition of "Lot Line, Front" to consider the widest street frontage as the front <br />lot line, instead of the narrowest street frontage on a corner lot. <br />2. Pursuant to Sections 265-31.D. and 265-45.I. of the City of Sunny Isles Beach Land Development Regulations, the <br />Applicant requests a variance from the pool setback requirements to decrease the minimum street side pool setback <br />from seventeen feet (17') to four feet and eleven inches (4'-11"). <br />3. Pursuant to Section 265-31.D. of the City of Sunny Isles Beach Land Development Regulations, the Applicant requests <br />a variance from the front yard setback requirements to allow a roof overhang to encroach into the front yard by four <br />feet and ten inches (4'-10"). <br />4. Pursuant to Section 265-31.D. of the City of Sunny Isles Beach Land Development Regulations, the Applicant requests <br />a variance from the street side setback requirements to allow a roof overhang to encroach into the street side setback <br />by three feet (3'). <br />5. Pursuant to Section 265-31.D. of the City of Sunny Isles Beach Land Development Regulations, the Applicant requests <br />a variance from the side setback requirements to allow a roof overhang to encroach into the side setback by two feet <br />(2'). <br />6. Pursuant to Section 265-31.D. of the City of Sunny Isles Beach Land Development Regulations, the Applicant requests <br />a variance from the rear side setback requirements to allow a roof overhang to encroach into the rear setback by four <br />feet (4'). <br />The plans reviewed are on file and may be examined in the City Clerk's Office. The plans are entitled "Gabay Residence," by <br />Toma Design Group Inc., stamped received March 18, 2025, consisting of 11 sheets. Plans are subject to revisions based upon <br />comments provided by zoning staff of the City of Sunny Isles Beach.
